It was vary clearly shown that his wife was not where she could have endorsed the check, an d;thal l jury were satisfied by the similarity of handwriting between defendant's own endorsement and I ' that purporting to be his wife's, and. from the cireuni stalies given in evidence, that the " Colonel" forged the endorsement. They hesitated but 'a Alert limo. The indictment laid the offense with tho word " feloniously," as required by one section 'of the statute under which the offense was prosecuted.' It is doubtful whether the case comes within the act of 1867; and to sustain the indictment, under, the other section of the code, the word " feloni ously" must be considered surplusage, and 'mere matter of form, which must have been taken ad vantage of before the jury was 'sworn. Another' . indictment was premehted, and the motion in an, rig, of judgment was not made ; so the question remains undecided. At common law, a convic tion for a ruldemetinor could not be- had on an indictment f 7 a felony. Sentenced to two years and four months' imprisonment r ia Jhb, Reiterk Penitentiary.
