JunLin, of Juniata county, appeared be fore tho Supreme Court this morning to make a final appeal on behalf of William Josiah McMeen, whose conriction of wife murder wss sustained in an opinion deliv ered by Judge Paxson about two weeks ago. Mr. Jnnkins motion wss ror a rear gunient or tbe case. The testimony against McMeen was entirely circumstantial, and one or the strongest points in the Common wealth's chain of evidence was the state ment of witness Dwight Mead that at nine o'clock oo tbe morning when the prison er's wire died, McMeen informed him that she was dead, before be could poaaibly hare received any communication to that effect. Mead has now voluntarily made tbe following affidavit berore the Mayor of Ilsr risburg: Dwigbt Mead, who was a witness in tbe trial of tbe Commonwealth of Penn sylvania against W. J. McMeen, and at the time testified to the fact that McMeen, bad told me at nine o'clock in the morning, the day thst Lis wife died, that be had just re ceived a telegram announcing toa death or bis nife, now desires to make tbe follow ing modification and correction of my tes timony : 'When I testified on tbe trial of the case X told what I believed to be correct, ac cording to the best of my recollection at that time; but since that time, having thought orer the matter, and called to tnSnil i..-,.....t 1 a. . v. V vuiiuiBMiiua which at mv iui testified, were entirely overlooked -or an' thought of ; and, being convinced that I could not possibly have met McMeen a early as nine o'clock A. M. of that day, I thought at the time I believed that I had gone down town earl in the morning, bnt I am now convinced that it was between eleven and twelve o'clock A. M., or there about. I make this statement voluntarily, after having thought the matter over fully." Mr. Junkin arged that with this correc tion Mead's testimony would agrsa with that of tbe wit nee wbo (wore that the new was brought to McMeen by a messen ger, who arrived at 12.30 P. X., and that tbe Commonwealth was therefore deprived of its strongest piece of evidence. The Court reserved it decision. Sale RegUter. J. C.
