having arrived at the point of destination,
but are Hill hopeful. We axe now thirty

the defendants, undivided. Ou 10th
March, 177, at the instance of defend
ants, writ to make partition issued, and
returned unexecuted. On 2nd May,
1877, at the instance of plain'iff, alias
writ to make partition issued, execut
ed 30th May, 1877 and returned on
3rd September, 1877, when exceptions
were filed by plaintiff, to the manner in
which the writ had been executed. The
writ commanded the Sheriff and Inquest
to divide tbe premises into two equal
parts, aud one of thcSe parts to be de
livered and assigned by the Inquest to
the plaintiff in severalty, and the other
part thereof to be delivered and assign
ed to tbe defendants. The Inquest did
divide the whole into two parts', valu
ing No; 1, containing 30 acres aud 6
perches, at $2,009,29. and NV2, con
taming 30 acres and 6 perches, at $2,
171,70 and assigned No. 2 to tbe
plaintiff, and No. 1 to tbe defendants.
The exceptions by tbe plaintiff were as
fallows: First. The Inqnest could not
assign imparts, nor could tbe Shcf iff.
Second. Tbe writ Was improperly
made oat. "And now to wit, 16th
October. 1877. the judgement entered
in this esse on the 10th of March, 1877,
is hereby stricken from the record and
