The Conspirators Trial
PAYNES REPORTED INSANITY.
TESTIMONY OF PHYSICIANS.
WASHINGTON, Jun# +4.
The previous day's record vyas partly
read, when the Commission took a recess
I until two o'clock, in order to allow the
examination of Payne by the commission
! appointed for that purpose. The Cotii
; mission re-assembled at two o'clock. Mr.
j Duster stated that h~ had closed the
: defense in the cane of payne, and did not
| propose to call as witnesses the medical
i jreiitlomen who had been appointed toin
j vestigate the condition of l'ayne as to in-
sanity.
Judge Advocate Holt stated that those
gentlemen would be called for the Gov
ernment. Re-exaiuination of Dr. Hall i
by Judge Advocate Holt. Witness ex- j
amincd the prisoner Payne this morning i
and was agisted by l>rs. Norris and Por
ter, and was subsequently joined in the .
examination by Surgeon General Barnes.
'J'he; prisoner was asked almost the same
questions that were put to him yesterday, j
in order to ascertain whether his answers
would bo similar, lie answered to-day
with rather more promptness than before,
and his ansyrers were much the same.
Question—Are you now prepared to ex
press an opinion whether or uot in your
judgment the prisoner is a safe and re
sponsible man ?
Answer—l am now prepared to say
that there is no evidence of insanity. —
The prisoner's mind is feeble and uncul-1
tivated? but I cannot discover sufficient
evidence ot mental incapacity.
Crom-examined by Mr. Doster. Ques
tion —What are you prepared to state as
to his n.'>ral iusapity.
Answer — >\ e asked him to-day whether
lie believed in a God, and he said he did,
and believed he was a just God. He al
so acknowledged Ui mo that at one time
he was a member of the Haptist ehurch.
| I asked Jjini the question whether he
thought that the assassination of au eue
!my in time of war justifiable. He said
i he believed it was.
Examination of Dr, orris—the wit- S
ness, in company with Surgeon-General
Barnes and other medical gentlemen,
made an examination this morning of the
prisoner, Payne, and arrived at the opin
ion that he was sane. There was noth
ing in the prisoner's looks, speech, or
ponduct tQ indicate that he was of un
sound mind. On th contrary, his reason
ing faculties appeared to be good, q4 also
lws judgment.
CjrQSs-exaniioed by Dr. Doster.—rj am
not familiar with cases of insanity ; don't
think th? coudifot of (Jje prisoner during
examination could have been that of a
madman.
* The prisoner might be a monomaniac.
If such wasO'e ease, witness would prob
ably have had his suspicious aroused, as
such persous almost invarialjv* in con
versation with strange parties, refer to
the subject of their insanity.
Examination of Surgeou Oen. Barnes
by judge Advocate Holt—The prisoner
l'ayne was examined by witness and oth
er medical gen*kmen, but no evidence of
insanity was disc'Vered. Tho Coherent
manner in which hs narrated bis story of

pation, more important than hw reitera

Examination of Dr. P<>rtor by Ju 'g>
Advocate tlolt. —Having been present
this morning at the examination the
prisoner Payne, witness believed h\ WlB
sane. Prjfoner had been under witnfees
oare since his confinement in the arsl
and from the inspection which be male,
witness had arrived at the (lonclusiou thit
prisoner was a sane nitjn.
The cross-examination of this witness
was mainly with reference to what con
stituted mental and moral iusanity, an I
was terminated by the President ot the
Court objecting to* the course of examina
tjon as improper.
Assistant Judge Advocate Bingham
entered upon the record several papers,
among which was a certified copy of a
resolution of the United States Senate,
consenting to and advising the nppoint
ment of Win. 11. Seward of State, and
the qualification of Andrew Johnson 011
the 15th of April, 1805, as President.
Judge Advocate Holt said that smiie
additional testimony, relating exclusively
to the general conspiracy, and nit effect
ing either of the prisoners particularly,
would he offered in behalf of the Gov
ernment. it having been understood that
one of the alignments for the defense had
been prepared, lie desired the Court to
hear it, notwithstanding that it should he
handed in before that argument was pre
sented to the court. It hai been tlm't
possible that Mr. Johnson hinisidt would
be present to-morrow to deliver an argu
ment in person. If he was not on hand
Mr. Clompett, by agreement among 'hi
counsel, would present the argument to
the court.
The Judge Advocate enquired as tt
which of the prisoners the argument was
intended to apply.
Mr. Aiken said it was an argumeti
relative to the jurisdiction of the Cou t
which was prepared by Mr Johnson, anu
in which ull the coun-cl concurred. 1
was intended for all me prisoners.
Assistant Judge Advocate Hinghnit
said. Mr. Johnson was not counsel for al
the prisoners.
General Wallace said, if the ar- umcn
• -ii the jurisdiction o( the Court was rea
dy. it would not he improper for the t oui
to hear it, mi I in order to settle tlietjuy
tion, he moved that the cniirt he cleire i
