'J'he; prisoner was asked almost the same questions that were put to him yesterday, j in order to ascertain whether his answers would bo similar, lie answered to-day with rather more promptness than before, and his ansyrers were much the same. Question—Are you now prepared to ex press an opinion whether or uot in your judgment the prisoner is a safe and re sponsible man ? Answer—l am now prepared to say that there is no evidence of insanity. — The prisoner's mind is feeble and uncul-1 tivated? but I cannot discover sufficient evidence ot mental incapacity. Answer — >\ e asked him to-day whether lie believed in a God, and he said he did, and believed he was a just God. Assistant Judge Advocate Bingham entered upon the record several papers, among which was a certified copy of a resolution of the United States Senate, consenting to and advising the nppoint ment of Win. 11. Seward of State, and the qualification of Andrew Johnson 011 the 15th of April, 1805, as President. Judge Advocate Holt said that smiie additional testimony, relating exclusively to the general conspiracy, and nit effect ing either of the prisoners particularly, would he offered in behalf of the Gov ernment. it having been understood that one of the alignments for the defense had been prepared, lie desired the Court to hear it, notwithstanding that it should he handed in before that argument was pre sented to the court. It hai been tlm't possible that Mr. Johnson hinisidt would be present to-morrow to deliver an argu ment in person. If he was not on hand Mr. Clompett, by agreement among 'hi counsel, would present the argument to the court. The Judge Advocate enquired as tt which of the prisoners the argument was intended to apply. Mr. Aiken said it was an argumeti relative to the jurisdiction of the Cou t which was prepared by Mr Johnson, anu in which ull the coun-cl concurred. 1 was intended for all me prisoners.
