U.S. District Judge Gustave Diamond denied a defense motion made Wednes day to throw out the 87-count indictment against Zemprelli and three other prin cipals in Earned Capital Corp., a bank rupt investment and real estate development firm. Defense attorneys claimed the gov ernment didn't introduce enough evi dence to continue the case. Also charged are Thomas J. Reily, 51, of Butler County, one of Earned Capi tal's founders; Philip Joyce, 53, of Brid geville, an accountant and ECC sales executive James Wayhart, 61, of Bethel Park. Earned Capital promised investors returns of 9 to 13 percent, with earnings to be paid from tenant rents on the townhouse projects the company devel oped. The rents, however, allegedly failed to produce enough income to pay the returns. Earned Capital allegedly continued selling shares to new customers and allegedly paid off earlier obligations from money provided by the new inves tors. If convicted, Zemprelli faces up to 160 years in jail and $8 million in fines. The trial is expected to last at least another month. Zemprelli, 64, of Clairton, Allegheny County, served in the Senate from 1963 until his retirement in 1988. He spent 10 years as Democratic leader.
