Hays, the former congressman who made the name of sexy Elizabeth Ray a household word, was sworn into the Ohio House of Representatives yesterday and promised to "be very ukeful and not make a nuisance of myself." Ilays, 67, who resigned from Congress in 1976 after a 28-year career broken by a sex scandal involving Ray, was assigned a seat in the back row of the Ohio House chamber and put in an out-of-the-way office on the third floor of the Statehouse. , But in talking with news reporters, Hays displayed the same.crust which once made him the scourge of Washington bureaucrats.. He was asked by a newswoman about his descent from one of the most powerful positions in Congress. "Well, honey," he responded, "that was a figment of your ( the media's) imagination. I wasn't all that powerful." Hays said he doesn't regard the change from Congress to the Ohio House as a "comedown," pointing Judge denies Flood dismissal request WASHINGTON ( UPI ) A federal judge indicated yesterday he will reject a defense motion seeking dismissal of the bribery and conspiracy indictment against Rep. Daniel Flood, D-Pa., because he is "very reluctant" to postpone Flood's Jan. 15 trial. U.S. District Judge Oliver Gasch said, however, he would help defense attorneys get financial records they say might exonerate the 74-year-old congressmen. Flood, a 15th-term House member overwhelmingly re elected in November despite a 13-count indictment against him, is accused of conspiring to accept $65;000 in payoffs, 100 shares of bank stock and the promise of $lOO,OOO more. His lawyer, Axel Kleiboemer, told Gasch financial records of Flood's former top aide, Stephen Elko, and Elko's wife, Patricia Brislin, were "at the core of this case." Seniors and Graduate Students. And asked if he had drawn any committee assign ments yet, Hays replied: "A young reporter was pressing me about that not long ago, and I said, 'Tell me, sonny, do they have a foreign affairs committee up there (in Columbus)?"' Hays met his demise in Washington after publicity over his affair with Ray, a 27-year old blonde who was listed on his congressional payroll as a clerk but who served as his mistress. Hays decided to run for the Legislature in 1978 when Rep. A.G. Lancione, D-Bellaire, announced his retirement after 32 years in the House. He won by only 1,700 votes. After taking the oath for his new position, Hays said he has received an "extremely cordial" reception from fellow House members. "Where did the money go?" Kleiboemer asked. "I'm going to show to you that Mr. Elko put every penny in his pocket." Elko, convicted in a 1977 kickback scheme involving West Coast trade schools, later cooperated with the government and will he a key witness against Flood. "Give me a chance to get it ( the records)," Kleiboemer pleaded with Gasch, asking at least for a delay until early February. "I am very reluctant ... to grant a continuance," Gasch said, but told Kleiboemer he would try to help him get bank records and other documents in the next several•days. Kleiboemer and his associate, Walter Fleischer, sought to have the indictment distnissed on grounds it violates the "free speech and debate clause" protecting Flood's actions in Congress. He was asked if there was any resentment toward him. "I already detect a little resentment toward the media for trying to take my picture while they are trying to work," he replied. "I haven't had any problems," he continued, "and I don't anticipate any. I just hope to do a good job for the people who sent me here." Hays said he plans to fight for elimination of the Ohio Board of Regents and a prohibition against utilities passing emergency fuel procurement costs on to con sumers. He also said he will be "birddogging" a lot of bureaus of the state government, including the Department of Transportation to take a look at "some of the potholes down in my district that are so big you can break an axle in them." Hays has purchased a condominium in suburban Upper Arlington, and may get a district office with his own staff.
