Press vs. courts Opinions on the Farber case By United Press International ' Some published opinions about the Farber-Times reporter's confidential notes dispute Vermont Royster, contributing editor, The- Wall Street Journal Let us imagine, for a moment, that you have been arrested and charged with a crime you did not commit. ,• And let us imagine that some newspaper or TV reporter in the course of his activity has learned in confidence Something that might help persuade a jury of your innocence. What right do you as defendant have to the reporter's testimony if he declines to give it voluntarily? What power has a court to issue a subpoena compelling the reporter to testify and to jail him if he doesn't comply?. . . The First Amendment is indeed a cornerstone of all our liberties, protecting as it does the right of every citizen to speak and to write freely (but) there is nothing in it that gives a reporter pn a newspaper any right to ignore laws 9 pplicable to all. , Editorial, The Wall Street Journal We find ourselves attacked this morning by one of this newspaper's great or naments, Vermont Royster . . . James Kilpatrick, columnist On Aug. 4, when Farber went to jail, he appeared to be acting as a martyr in a noble cause. Subsequently, it transpired that Farber had entered into a lucrative contract with Doubleday ,to do a book about the Jascalevich case. The effect was to leave a ring around the collar on his white robes of virtue. It won't wash. Editorial, Los Angeles Times If the press can be forced to disclose its con fidential sources, those sources soon will no longer be available, and the public will be deprived of a broad spectrum of important information. This principle was in no way un dermined by the disclosure that Farber has been writing a book . . . (Judge) Lacey, acting as though he were per sonally affronted, went beyond the legal issues to indulge in irrelevant speculation.
