Council will also consider overriding the veto by Mayor Arnold Addison of a proposed off-street parking ordinance, passed 6-i by council on Aug. 7. The smoking ordinance, drafted and to be explained tonight by the State College Board of Health, imposes a $lO minimum and $lOO maximum fine with prosecution costs or a maximum jail term of 30 days for failure to comply. The ordinance does not apply to bars and other alcohol-related eating and drinking establishments. Also, the proposed legislation says that "reasonable" smoking and non-smoking areas shall be provided in other "places of assembly," at the proprietor's discretion. In a copyrighted article in Sunday's Dallas Morning News, FBI agent James P. Hosty Jr. was quoted as saying: "If they are going to try and contain this investigation like the Church (Senate Intelligence) committee and the Warren Commission, they don't want me up there." Although he said he generally agreed with the Hosty was the FBI agent in Dallas who monitored Lee Harvey Oswald's ac tivities before the Kennedy assassination on Nov. 22, 1963. Hours after Kennedy was killed, Hosty was quoted in a top-level FBI memo as stating the FBI knew Oswald was capable of killing Kennedy. Addison also said he vetoed the ordinance because of citizen complaints about parking in the South Hills Business School area and because it fails to mention retroactivity. Holtzman has called these objections minor, and other members have said they can be corrected by later amendments. Addison, however, said the ordinance is "a sloppy piece of legislation." He said he prefers the amend ments be made before, not after, the ordinance is passed. He said if amendments can always be made, then developers and investors will not know whether the ordinance is intact.
