Strachan has contended the indictment ought to be dismissed because of the nationwide attention his testimony received at the Senate Watergate hearings in July, 1973. Strachan received immunity, for his Senate testimony, but Jaworski contended the indictment was based on other evidence independently ob tained. The U.S. Court of Appeals on Sept. 20 denied Strachan's motion for a writ of mandamus to dismiss the indictment. Chief Judge David L. Bazelon said, however, that the motion raised troublesome questions that would have to be taken up at the end of the trial, and Judge George MacKinnon dissented to the ruling. "Our position has been that nonevidentiary use of immunized statements irrespective of the nature or extent of such use is not prohibited..."
