We make the -following extract from the
able and moat eloquent defence of the United
States Supreme Court, by Senator Benjamin,
of Lotesantr, on March 11th, in reply to Sena
tors Seward and Hamlin, who bas spoken dis
paragingly of the court and particulary so of
Chief Justice Taney, as also of President
Buchanan.
There are few men in the Senate or in the
country possessing finer oratorical powers
than Mr. Benjamin, and his defense of the
Chief Justice, the President and the Court
does honor both to his head and heart :
Now, Mr. President, I come to another point
in my argument, which I approach with extreme
pain, with unfeigned regret. From my earliest
childhood I have been taught to revere the judges
of the highest oonet in the land as men selected
to renclei justice between litigants, not more by
reason of their eminent legal acquirements than
because of a spotloEe purity of character, and
undimmed lustre of reputation, which removed
them far, far beyond even a doubt of their in
tegrity. The long line of eminent judicial wor
thies, which seemed to have culminated in a
Marshall, has been continued in the person of.
one upon whom the highest enlogium that can be
pronounced is to say that he was eminently - wor:
thy of being , the successor of that illustrious
judge. I know not, Mr. President, whether you,
as I, have had the good fortune to see that,
magistrate in the administration of justice in his
own circuit, or in the court sitting below us, - of
which he is the honored chief. know not, sir;
whether it has been your good fortune, as it has
been mine, to hearth° expressions of affectionate
itverenee with which ho is spoken of bythe peo
ple amongst whom he has passed his pure, his
simple, and his spotless life I know not, sir,
whether you have-listened, as I have, with in
terest to the expressions of respect and admira
tion that comes frein the members of his bar in
their familiar intercourse with each other--e-spon
.ls.neous tributes, worth a thousand labored eulo
gies,to his eminent sagacity, to his vast legal
learning, to the Mild and serene dignity of his
judicial deportment—above all, sir, above all, to
the conscientious, earnest, almost painful sense

nage was carried from points west of Pitteburgh
for less than from Pittsburgh east, but showed
th a t it was a necessary result of the tonnage tax.

more than fair renumerating rates for freight'
