Important. Conspiracy Case.
Quarter Sweimu.--Judge McClure.
This Is an indictment for conspiracy against James
M. Walker, Martin Walker, Theodore C. Vs alkor and
Louisa Btoip, which charges the defendants with
having combined to charge James kelly with rape,
fornication ruadbastardy, and assault and battery upon
Louisa Stoip, for the purpose of extorting sums of
moneys amounting to $7OO, from said Kelly. Mr.
Kelly is a riot] man about sixty years of age. Louisa
Stair is a German woman, a pauper in the Poor
House. Walker was the warden of the Poor House
and resided with his family thereat.
R. Biddle Roberta, George P. Hamilton and John
Hampton appeared for the prosecution. Col. Wil
son M'Candless, Thos. M. Marshall -and Alfred B•
M'Calmont for the defence.
Mr. Roberts in his opening stated to the jury that
the defendants disagreed with the prosecutor as to
the manner of conducting the Poor House, and they
therefore threw around him a chain of circumstances
Widish compelled him to resign his office of Director
of Poor and pay $7OO in order to secure himself from
a public irivestigiten ; but that a fourth demand in
duced him to bring the prosecution.
Mr. James Kelly, steers.--I was ono of the Direc
tors of the Poor in 1855; was elected at the general
election in 1851 ; the Board at the time consisted of
Mr. Varner, Mr. Boyle and myself; know James M.
Walker; he-was warden of the Poor House in No.
vomher, 1855 ; know Theodore C. Walker, the son ;
he was in the employment of the Directors of the
Poor as an assistant at that time ; he got ten dollars
per month was at the lone House on the 27th day
of November, 1855: all the members- of the Board

other Directors; saw a woman there whom I after
wards
learned was Louisa ; saw her on the I
27th of Novennbert, was at the fountain in the yard
when a woman came up to use and said I was wanted

WAEIRINGTON CITY, April 9.—. Senate—The debate
on the question of printing the memorial of the Kan
sas Legislature, presented by Mt. Case, was resumed.
Mr. Butler opposed the motion on the ground of
the memorial being arrogant in language. To print
it would be to violate one of the rules of the Senate.
Ile had no objection to Kansas coming into the Union
either as a free or slave State, but wanted it to enter
honestly through the gate, and not climb over the
wall or sneak under it.
M. Mason thought the memorial ought not to have
been received, but now should move that it be laid
or, the table.
Mr. Seward desired to be heard on the question.
The subject was postponed. The special order was
resumed, being Mr. Douglas' Kansas report.
Mr. Seward having the floor, proceeded to address
the Senate. lie said the constitution presented two
qualiforationr for new Stal9P. vie: a substantial civil
community and a republican government.. Kansas
has both of these. The circumstances of Kansas, and
her relations toward the Union, are peculiar and
anomalous and deeply interesting. Tho United
States acquired the province of Louisiana, which in
included the present Territory of Kansas, from
France in 1001 by a treaty in which they agree
that its inhabitants should be incorporated into
the Federal Union, and admitted no soon as possible,
according to the principles of the constitutior,
to the enjoyment of all the rights advantages
and immunities of citizens of the United Stater.
Nevertheless, Kansas was, in 1820, assigned ass the
home, for an indefinite period, of several savage In
dian tribes, and dosed against fibmigration, and all
other than aboriginal civilization, but not without a
eoteniporatietius pledge to the American people and
to mankind that neither slavery nor involuntary ser
vitude should be tolerated therein forever. In ISO I,
Congress directed aremoval of the Indian tribes, and .
organized and opened K auras to rivilization, but
that rattle art rescinded the pledge of perpetual ded
ication to freedom, and substituted for it another,
which declares that the future people of Kansas
