In order to evade the payment of toll, you informed him that yrs{ were a hand in the em ployment of one of the bridge directors. We thus trace the origin of this affair to a matter of fraud and falsehood- And we also trace in it another in stance of the deplorable consequences resulting from disregard of the maxim that would teach all men to 'avoid the beginning of evil." You persisted in your attempts to pass under this pretence. The deceased, true to his trust, would *- permit you to do so. In consequenc e of this, yen had, on different occasions, angry disputes and wren.- 'gles eith him and with the young man, who assisted • him in the collection of tolls. Two or three months passed on, characterized, so far as your intercourse with the deceased was concerned, by these unpleas ant occurrences. Although on Saturday eveningleu had a violent altercation, (arising from your persistence. in these attempts,) in the course of which you were shoved away from the toll house. Looking at the de erased and the young man who was his assistant, you then declared "you would be God damned, ff the, would stop you again. if you would not cut the guts out of some of them." On Monday evening you car ried this threat into literal and fatal execution. You were again attempting to pass without paying- Youi were followed by the deceased. You added insult to meditated fraud. You threw 'down the toll, (which was two cents.) contemptuously on the ground, instead of paying it like a man and a gentleman. The provo cation was a strong one, and had the effect it was prob ably intended to have. He took hold of you. With a long bladed or dirk knife you quickly gave him a mortal stab on the left side of the stomach from which his bowels protruded, and of which, after suffering' great pain, he died the next day. No one saw you take the knife out of your pocket cud opening it, as if fur the purpose of defending yourself from an unea; petted attack. At least there was no evidence of this. I Was it not already in a state of preparation for are event of your ow n seeking. You produced the evidence by a witness to prove that before you gave the fatal stroke, the deceased bad shaken and kicked you. Whether the jury reposed. confidence in the accuracy of 'hat statement, contrti; dieted as it was by other evidence, it is not for us to determine Butif they did, they probably acted be. the belief that any agresai on on the part of the deceased was designedly provoked by you for the purpose of gaining en excuse, and an opportunity of wreaking your vengeance npon him. Your former and repeated altercations with him—the hostile feelings which you evidently cherished—the old grudge you harbored—, the threat you previously made--your lawless and, in. milting conduct on the occasion—and the nature of the weapon you employed, furnished the jury 'with good grnunds upon which to predicate such a conclusion, end pointed you out ns one "dideoid of social duty and fatally bent on mischief." After &calm aod deliberate review of all the proceedings in the case, we cam find noshing to warrant us in disturbing their verdict. Your - friends no doubt bewail your case. In their grief, perhaps, they call in question or necessity of the proceeding that has, in the end, pronounced your life tbo only forfeit that will satisfy the offended majesty of the law. But let them turn from your case to that of the unfortunate man who has fallen a victim • beneath your cruel and blood stained hands. You are a young man, unmanied, and in the prime oflife. The deeeas ed was the head of a large family. He was well known alai esteemed in the community as a good zen—and an honest upright man. In taking his life, you have robbed a wife and many children of their friend and protector. You have reduced them to a state of dependence. In outlines of blood you have 'left on their memory a painful scone that will intrude, itself upon any prospect of happiness that may spring up for them in after life. The moment the fatal blow was given, you fled, you 1 afterwardsdet lared you were nut the person -at all that committed the act. You were taken to the couch of I the dying man, and there confronted with him.-- "He regretted (in the language of an intelligent wit nese) that he had no ptoperty to leave to his children, and did not know what would become of them.te- Nothing can better portray the grief and wretched ness—the ruin and desolation, that were brought by your murderous act to the hOrne and hearth of that worthy and numerous family. Thoughts of his and children rushed upon him at that trying moment. But even the presence of the murderer in their whist extorted from him no expression of anger—no throws of retaliation or vengeance—scarcely ,a word of ten preach. lia turned his head, and looked at you and said, "that is the unfortunate wretch. May God for give him!" We make these remarks in no spirit of vindictive ness, or even of unkindness; but because it is due to yourself and the public, that the awful position itt which yob stand, and the causes that have led to it, should be understood.
