Oar remarks in lust Tuesday's Post,
upon a paragraph, copied from an Aboli
tion paper, reassuring its readers that
Mrs. Lincoln was preparing for a:t utiusu
ally gaywiotcr, appear to have aroused
the indignant gallantry ot one of the
“ gifted m ; ndßV belonging to the Cvinmer
cial printing company. We d- not r»
member haviug written anything at all
objectionable ; certainly nothing so ina«l
missible as the abolition of
the determination to t-xelude persons with
“ large feet and coarse boots” trom the
privilege of the coming series ot Presiden
tial entertainments. After two days re*
flection, however, the gallant and gifted
person alluded to, comes to the rescue ,
and, as is usual in sach cases, whore there
is no defense required, he oniy succeeds
in writing himself “an ass.” He com
mences his defence ot Mrs. Lincoln from
an imaginary assault, by quoting the to!
lowing lines of singling verse :
“ That hkid wd» lajr hi* hand up.n a wuiLau,
Save in me way of Mminegfl, is a wretch.
"Whom 'twere yroae flattery to name a coward.' -
Those who read our remarks which cal
led forth this quotation, will at once see
how hard was the Commercial's condition
for something to bay; no wouder the
writer considered his subject for two days.
Beaidee, this “ gifted mind ” is at fault in
quoting the iineo of Tobin at all ; fur, it
was said ot that Hover dramatist, that he
was shamefully addicted to the practice,
which he. in hia play, makes the Duke
Aranza so pointedly condemn. We trust
that no one of the “ gifted minds' about
the Commercial :s guilty like proceed
ings.
The Commercial as it pr-*-- e.-ds lr.,m
Tobin’s blank verso, 10 its own powerful
prose, grows more serious, in reply to
our statement that Mrs, Lincoln had been
enjoying ‘‘the sweet, amiable, virtuous
and instructive society" of the modest ana
retiring Mrs. James Gordon Bennett, and
also that of the fashionable Chevalier
Ws'eoff, cur neighbor indignantly in
quires, “who told you that Mrs. ILnnett
was not a virtuous woman? ' And then
to cap the climax, the “gifted mind”
triumphantly exclaim j, “would not a
whipped spaniel be ashamedot such cow
ardly inuendoV Here we pause, and
acknowledge ourse!' cornered, “a whip
ped spaniel being ashamed c-f cowardly
innendo,” rather takes us, and we cry for
quarter.
Bat while upon oar knees may wo net
modestly venture to inquire what all the
Commercial s bluster and nonsense

that establishment know, that theconbiLt
of their fair heroine has given scandal,
until papers of the respectability of the
New York Evening Pi-st, have hot.:, com
pelled to notice it l>o they nM know
that she has been r-bu Led for receiving
the visits of Wykofk, a notorious adven
turer and 7V/«n whom th j Evening Post
declares is shunned by all respectable
New York society it they do not know
these things, we will pardon their igno
rance, but if they do they only show their
want of a proper appreciation of public
journalism when they attempt to gloss
over each unprecedented proceedings.
Mrs. Lincoln's preparations for unusual
gaiety and folly is reprehensible, and if
she is determined to persist in it she and
her set must not expect to escape the lash
of ridicule. The coun try is not in con
dition for the carryings on of the Wr
koff’s at the White House ; and reasona
ble objection, to that National establish-;
meet being prostituted to such persons’
purposes, will not be construed by sensi
ble people into laying “violent hands upon
a woman, 11
But the Commercial's bluster may be
intended for the atmosphere of Washing
ton : it may have a poiot to make at head
quarter?. ; ii so it has put its buncorae on

Our radical contemporaries have been
able to discover in this circumstance the
evidence of great energy in the War De
partment, and have awarded Mr. Stantou
such praise as must, with those who can
perceive its fitness, go far to atone for the
absence of energy in the purely military
operations c f the war.
For oi.r parts we can see in this per
fortnanc * ouly one more crime committed
by Secretary StantOD and President Lin
coln against the Constitution and the laws
which they have sworn to support. The
fat and comfortable secretary will jeer at
this reminder of hia solemn oath. The
President will tell a story which the alia
6ion recalls : but Time does nut halt to
give them security, and a day is hastening
when they wiii not jeer at Aheir perjuries,
and will not be able to evade the laws
which they have broken and Bcoifed.
Ui \\ m. T. Smithson’s guilt or innocence
w f knuw nothing. He is a citizen ot
Washington, convicted by the general
court-martial of holding correspondence
with and giving intelligence to the enemy,
in violation of the fifty-seventh article of
war. which prescribes death -,r a leas
punishment, as the penalty of that offence
We will not discuss the question of his
innocence, but grant at once that he com
mitted the offences charged against him,
\Se assert, moreover, that if his guilt won
established in the proper courts of law, in
spite cl his every effort under the ;orms
and protection of law to rebut the proof o!

tiary is too light a punishment. li*-

nothing short of treason. He owed el!e
giance to the United States: he gave u:-j
and comfort to the .enemy, and for that
crime Congress has prescribed the penalty
of a deserved death.
Again, if Mr. Smithson had belonged to
the army in any capacity, high or low.
and had been proved, in a general ,spurt
martial, guilty of the crime of whfah he
was charged—giving intelligence lo the
enemy thqn he should not have been let
off with a few years in thp penitentiary,
he should have been sentenced to a\d
suffered death. The articles of war, au
thorized by Congress, give courts n.urtoP
each power, and it is essential to the

public safety, by those most trustrd to
preserve and defend them. It ir treach

Is any reader so little acquainted will,
the history and laws of hie country as lo
regard this as strained language— as too
severe comment upon the action ot the
executive officers, engaged in carrying
on a war Well, we want the war to sac"'
ceed as much as Mr. Lincoln wants it to
but we don’t want the punishment of reb
els for violating the Conetitntion to be hir
or any one else’s excuse for doing the
same thing in ways less assailable because
more incidious, less punishable because
less ojtin ; but not lees wicked, not less
fatal to all those civil and personal rights
which the Constitution guarantees.
But our language is not strained our
view of tLia matter is not —we neg
assure our sensitive radical friends ~ L-,
have such keen noses tor disloyally
no; in the least disloyal. Our view o:
the matter is the same which Congress
once decided to take. Our language If
tame compared to that in which Daniel
Webster (who is said to have known what
was constitutional and loyal I once per
suaded Congress to the same conclusions.
The debate occurred in 1814. when Mr"
Webster was representing New Hampsh.re
