On Saturday". oroner McClung held an inquest upon the body of Stewart Herbert, a single inan:pf about sixty-two, who re sided on Squikrel Hill, in the vicinity of Four Mile Rdn. It appears that he had been drinking pretty freely with some friends on liHday evening and started home at a late hour. He was found on Saturday morning with his face in the, Run, having drowti'ed in four inches water. There was a gash on his head and marks of blood uporha rock at the edge of the run From this position in which he was found it was believed he had fallen down and being unable to rise in his intoxicated condition waslrowned. The jury return ed a verdict of ':'accidental drowning. the Guerrilla. The Wheeling Inlelligencer gives the fol lowing details of the death of Sam High, the notorious giierriba The deceased, though he had taken the oath of allegiahbe, was engaged as usual in capturing the ipyal citizens of Hamshire county. Ambng others, he captured a man by the name of Speneer;and was pro ceeding along ,the road with him. High pent the balance of his cut-throats ahead to arrest some other Union citizens. After the rang had one, High said to Spencer, •'I intend to sand you where I sent Ar nold," alluding', to a man he had killed some time befdie. After a while, High placed his gun ,against a tree, and Spencer, watching his opportunity, seized the gun And'shot High through the heart, 'killing him instantly. On, Saturday morning, in the Supreme Court, Judge Strong delivered an able and lengthy opinion 'mpon•the motion for a temporary injunction in the case of Ewing vs. 'fhoppson, argued on Wednesday last. The co4clusion of the opinion and the de• tree were as follows : "It may be.that the decision of the Su preme Court, on the hearing of the certio rari will result setting aside the decree of the Court of Qularter Sessions, and thus leave the originalireturn and the commis sion of the complainant in full force. On the other hand, di the decree be affirmed, the right of the defendant-to his commis sign, and to the emoluments of the office from the 21st day of October last, will be established. His title will then have com menced at the datelof his commission. It does not, however, give him a pree- 1 ent right to assum*the office, or interfere with Its duties. BRITISH 'STEAMERS CAPTURED 'This is a bill preferred by an individual, asserting a persona l right invaded. Yet it is not to be overlooked that it affects public interests.. The office of Sheriff is a most important one, and the question which of two persons claiming it may law fully perform its duties, is one in which the whole community is interested. We ought not to leave the mat* in doubt. Though we cannot now determine finally who has the right, we can arid ought to determine who is the Sheriff in fact, and prevent a conflict until there shill be an adjudication that shall terminate'' finally the election contest. We therefore feel constrained to award an injunction. "A speedy final dmision of the contest ed elction is imper,atively demanded by public considerations, In the light of these, individual interests and personal convenience are of iminor importance, though they are by no, means to be disre garded. We have no power to compel a hearing on the certiorari before the return day of the writ; but we have power to dis solve the injunction now granted, and we have power to impose. terms upon the al lowance of a common-lhw writ of certiora ri after judgment. It ia not a writ of right, and will never be allowed for merely tech nical errors which do not affect the merits. Indian Remains. In sinking foundations on the bank of the Allegheny, in the vicinity of the Lake Superior Copper Works, Ninth Ward, the remains of human beings have been found on several occasions, recalling from "the oldest inhabitants" the fact' that the spot was once an Indian burying ground. Iwo perfect skeletons have been found in ex cavating for Parke & Bros.' new steel works, one apparently that of a gigantic warrior, the other, from ,the numerous ornaments of gold and silver, such as cru cifix, bracelets, rings, diminutive bells, buttons, beads, &c., supposed to have been an Indian princess. A number of other bones have been found wherever the work men dig, and the cemetery Must have been extensive and long need by the red men. Some interesting relics of this fast-disap pearing race may be seen at the O'Hara Glass Works, Ninth Ward. The Lowrie Homielde—No Ver• Judge Mellon charged the jury in the Lowrie homicide case, at the opening of Court on Saturday mornings in an able and impartial manner. The jury retired at ten o'clock, at half past sit in the even ing they came in, without having agreed upon a verdict and Court adjourned until half put nine on Sunday morning to re ceive their verdict. At that hour they came in for instrueions, which they re ceived,in answer to four queries propound ed to the Court, in writing, and again re tired. The Court waited for ihalf an hour and being then no prospect of agreement, adjourned until ten o'clock this morning. The jury will then have been out forty eight hours and if they do riot return verdict then, there is no knOwing when they will. Pennsylvania Soldiers De eeased. The following Pennsylvania soldiers have died in Washington ciiy since last report: C. B. McKerns, Co. 2d Penn sylvania Artillery ; Patrick Kennedy, Co: 49th Pennsylvania; Matthias Fisher, Co. A, 134th Pennsylvania. Nettled. The difficulty in enforcing the draft in Bullskin and Saltlick, townships, Fayette county, has been amicably settled, and nearly all the recusants, having taken a "sober" second thought have reported at Camp Howe - for duty. The resistance originated in the: belief that the county had already furnished her full . quota, but as many gone into Virginia regiments, credit for all could not be obtained. Running Agniit.
