THE DUTY OF THE
When secession organized, and armed
itself, war, civit war, became inevitable.—
And when this Secession prevailed all civ
il federal authoiity became in fact sus
pended, and iti . - irevisal thereafter became
dependent on the defeat of the hostile or
ganization. Aithority t had lost its moral
force, ky loosing the affection% of the
South; audit hiid lostiti civil force by rea
son of the overwhelming force of the re
hellions Combination. The secession is
therefote complete,,tmleis we can subdue
it by force of time military power; and
until that is, done, Cr in so far as it is not
done, all federi l l civil authority is done.
What then are the laws by which the
test is to be cOnstractedT Can any one
doubt that the must be the laws of civil
ized warfare-? So alnioet all civil wars have
been cOnducted,and so we insisted and ob.
tained in relation to our revolutionary war.
• If informer tilies civil wars seem to have
been more cruel than can be justified by
the laws of
,citrilizid warfare, it is partly
because of the intense personal excitement
which usually attend such wan , : and part
ly because the laws of war have since be
came ranch aMhliorated.
And it is otpe utmost importance that
this should be, recognized by -us all as
the laiv of the occasion; for then we shall
all have one' and the same ruler to go by,
and shall' easily fall into the same path
and work, toggher in harinony. As' it is
now,, passion ISeems to be our principal
leader, and i must vary with all the
phases of the; war, and has so varied.
Every excitedi man thinkl his own pas
sion is the measure of legitimate warfare,
and some tryout one thing and some
another We hall get clear of these mis
leading excitements and divided counsels
only by beco4ing fully conscious that
there is a law above us, the law of civiliz
ed nations for Civilized warfare, by which
we must directiour course. It is only for
want of recognizing this that we have had
any divisions among mrselves ; for about
providing the 4iecessary forces and_ sup
- plies we have not differed. 4
All civil laW'and civil force is frustrated,
and military taw and military force has
taken its place The legislation that is to
rule the case took- place long_befcire the
case arose, and grew out of tie past ex
' perience of nations, and is embodied in
the recognized-codes of international law.
It is therefore above and beyond all
selfish or partiian excitement or-arbitrari
ness, and- forhiciii that either patty ito
the war shall ,hind the other by its legis
lation. ii

hostile ?ebellion, . Until then all our civil
legislation against the South is not in fact
legislation at all, but only threats of what
we intend to do ; and, conceding to the
South the earnestness and courage which
is
they have proved, we ought to know that
such threats only increase the force of the
influence that opposes us.
Faith in civil authority gives its force
far beyond its cal presence ; but it is not
so with militarspozver. It can legitimate
ly act'only where it is, and all its acts are
acts of force, authority. It can send
out no decrees that will bind its adversa
ries or, affects their institutions. Only its
presence in foqe can have any effect. 'We
have recognizedthis in shutting the South
ern ports by actual blockade, not by either
legislation or military decrees. All the
world has recognized it by condemning
Napoleon's Berlin and Milan decrees, and
the English orders in council, by which
the several p4ties shut all the ports of
their adversari4s in England, and on the
continent agaiant'all foreign commerce.—.
All now admit that these military decrees
were contrary to the laws of civilized war
fare. We went to war ourselves with
England on account of tliem in 1812.
Instead of veting the crude plans and
discordant scheines excited by our passions,
let us study andlpractice the laws of civil
ized warfare anciwe shall grow calm, coufi
dent and united, Under the guidance of a set
tled and impersgal authority. Real study
has always a c?llming influence and leads
us away from ourselves and our personal
disappointments; We shall cease to rely
on executive, legislative and party plans
for the aboliticin of States, and ports of
entry, and slavety, and for the confisca
tion of estate. J i All edicts and decrees on
these subjects mere aggravating threats
on waste paperi According to military
and international law we might as well
have abolished the monarchy of England
or its jariscliction over Ireland by a mill
terry decree during the war of 1812, be
cause thereby 9ui adversary would be
weakened, as do any of the above acts
during the continuance of the rebellion.
When the avowed secession is suppreesed,
we shall deal with all these matters by the
civil authority, i':ibcording to its legitimate
functions. 11

delphia fur Laguayra, was lost during a ter

fur of the gale that all hands ba,d to rash

of the bark, but even then three of them
Were washed overboard. During the,en
tire live days they had nothing to eat or
drink, until the fury of the gale bad sub
sided'.

NEwAai., N. J., Oct. I.—Two brick
buildings, ISt) feet long, being a I.ortion
of the extensive patent leather manufac
tory of L. P. Howell .1; Co., were destroy
ed by fire at three o'clock this morning.
A. large quantitypf knapsacks and leather
was destroyed. The .loss, which amount
ed to $25,000, is fully insured. The fire.
broke out in the drying room, and the
cause of it was accidental.
