President Lincoln has surrg loose from
the constitutional moorin of his inaug

opening of th two successive sessions of
Congress under his administration. He
is fully adrift on the current of radical fan
aticism. We regret for his sake, we la
ment for the sake or the, country, that he
rrls cc erred by the insanity of the radicals,
by the denunciation of their presses, by
the drats of their governors and sena
:dors that be should resign, into aproclam
ation which on hs face violates the Con
stitution it is contrary to the general cur
rent of of cifilization in th conduct of war
as i, has run since the Crusades, is in op
position to the solemn declarations made
by our goveri meat that this Was not to be
a war ofaubjagation, and in manifest ob
struction of . tit' 7.eunion and of those
States for which the nation has fought and.
is ready to lavish its blood and its trea
sure.
We demand to be informed whence the
President derives his power to issue any
such proclamation as he has now publish•
ed? Not from the Const4ution,•surely,
for it is in plain violation of some of its
feeding:provisions. Nut from the laws of
war, fur the laws of war tolerate no such
proceeding. Not even front the se-called
confiscati o n act, which the Prestdent was
at one time on the point of vetoing, for
the proclamatio is lade in - parsuance of
that higher law—that is to say, that open
di fiance of lavi-which has distinguished
the tribe of pestilent abolition agitators
from the beginning. Their moral notions
are so sublimated and transcendental that

Appointment of Provost Marshals,
The War Department has issued the fol
lowing order in relation to the appoint
ment and duties of Provost Marshals:
- First. There shall be a Provost Marshal
General of the War Department, whose
headquarters will he at Washington, and
who will have the immediate supervision,.
control and management of the corps.
Second. There will be appointed in each
' State one or more Provost Marshals, as
necessity may, require, who will report tr,
and receive instructions and orders frorn
the Provost Marshal General, of the War
Department.
Third. ft will be the duty of the special
Provost Marshals td arrest all deserters,
whether regulars, volunteers or militia,
and send them to the nearestmilitary com
mander or military post,. where they can
be cared for and sent to their respective re
giments; to arrest, upon the warrant of
the- Judge Advocate, all. disloyal persons
subject to arrest under the orders of the
War Department; to inquire iro.. and re
port treasonable practices; seize stolen orl
embezzled property of th Government;
detect spies of the enemy, and perform
such other duties as may be enjoined hpon
them by the War Department, and report
all their proceedings promptly to the Pro
vost Marshal General.
Fourth. E'o enable special Provost Mar
shals to discharge their duties efficiently,
they are'- authorized to call on . any availa
ble military force within theirs respective
districts, or else to employ the assistance
of citizens, constables, sheriffs, or police
officers, so far as may he necessary, nodc r
such teguTations as may be prescrtoed I - y
the Provost• Marshal General of the War
Department, It'll the approval of the Sec
retary of War.
. Fifth. Necessary expenses incurred in
this service will be paid on duplicate bills
certified by the special Provost: Marshal.,

month, and actual travelling expenses and

vice will be subject to be revoked at the
pleasure of the Secretary of War.
Eighth. All orders heretofore issued by
the War Department, conferring authority
upon other officers to act as Provost-Mar
