POST. ------- Ti to - Emancipat ion Proclamation. President Lincoln has surrg loose from the constitutional moorin of his inaug ural .address, and his messages at the opening of th two successive sessions of Congress under his administration. He is fully adrift on the current of radical fan aticism. We regret for his sake, we la ment for the sake or the, country, that he rrls cc erred by the insanity of the radicals, by the denunciation of their presses, by the drats of their governors and sena :dors that be should resign, into aproclam ation which on hs face violates the Con stitution it is contrary to the general cur rent of of cifilization in th conduct of war as i, has run since the Crusades, is in op position to the solemn declarations made by our goveri meat that this Was not to be a war ofaubjagation, and in manifest ob struction of . tit' 7.eunion and of those States for which the nation has fought and. is ready to lavish its blood and its trea sure. We demand to be informed whence the President derives his power to issue any such proclamation as he has now publish• ed? Not from the Const4ution,•surely, for it is in plain violation of some of its feeding:provisions. Nut from the laws of war, fur the laws of war tolerate no such proceeding. Not even front the se-called confiscati o n act, which the Prestdent was at one time on the point of vetoing, for the proclamatio is lade in - parsuance of that higher law—that is to say, that open di fiance of lavi-which has distinguished the tribe of pestilent abolition agitators from the beginning. Their moral notions are so sublimated and transcendental that they do not recognize the obligation of a compact, or the binding force of an oath, or the authority of a constitutional law du ly enacted. They acknowledge no law but their own unregulated impulses.— sectional hate, party spirit, political pas sions inflamed to 'diabolical fury—these are the."highcr law" of these wretched zealots, in compatis un with which the sa cred obligations of the fundamental law of the land, and the public law of nations, are as light, in their estimation, us the antihero of a gosstinier's wing. In obedi enee to this higher law of unreasoning passion they 111,dpi-took, many years t•go, to annul one diatastetul hut minor pro vision of the Constiortion : now they .tire louse reins to thtir fttnatcistn, and drive with it coach-iindalix through the very body of' the instritment. ' The Consti tut i LAU COL feni on the Federal Government no power to chang the domestic institutions of the States P this policy tuaktas alleges of the most violent and sweetaing character, changes whicti eveti the Republican pat:ty in its national conventions disclaimed any in. tention of of tusking and adinitted to be nstitutional. The Colititlaio n pro the property of all eiti ens from fbrfetture by civil penalty, with out trial land convii•tion : this pubcy in flicts heavy pimalties without even the pretense of a trial, inflicts them on the citizens of the whole States withont even the pretense of any discrimination be• tween the innocent and the guilty, blend ing them nil into one iudistioguishable muss, without an regard to whethe r they ha I borne army against the government or were non•comhataat•i. or t her they lad gone into the rehn;lion voluntarily or had been, coerced into it by the ti rroirsm which hits prevailed at the Simla. The Consti tution describes the crime of levying war against the United States as treason, at.ti makes certain broad regulations respect ing its puaishinont, hut the policy in ques tam assumes to punish levying war in a different way from what the Constitution allows it to be pro ished; by punishing it under some other name. A man cannot be constitutionally punished as a traitor till he has been first tried, but this policy attempts to circumvent the Constitutio n by inflicting the punishment under other forms than as a penalty for treason. A un iversal con fiScation.of thelprivate.property of non - combatants, throu hoot the whole States, without trial, without any . attempt to.A.:istitignish between inArent and guilty, or between the property of full grown male citizens and that of minors orphans. held by guardian or trustees, is alike contra ry to the Constitution and to the laws of civilized war, which respect the private property of' non-combatunts. .If we descend from the Constitution to the confiscation act, we shall find this ex traordinary proclamation indefensible even on the principles of that act. That -law does not art on the gross populatio n areas of country. The forefeitures it denoun ces are confined to persons in rebellion, against the• government. What can be more preposterous, ore more monstrous perversion of justice than to - make the guilt or innoc, enee of an individual depend on whether the State in which he happen ed to- be born) shall have represematives in Congress on the first day of January? It would he sufficiently monstrous to wake a trian's:',right; on his property depend on. :his own exercise of the elective franchise. Never was there so degrading a satire on Republican institutions as the compulsory voting required by President Lincoln.— But when a mans property is made to de penn not on whether he chooses to vote himself but oni whether his fellow citizens choose to vote and whether the number Voting under jthis executive compulsion happens to be ia majority, we are lost in astonishment that a chif magistrate of a free country Should undertake to make ciliate's perform what ought to be their freest act under coercion, and to convert the ballot-h o - - ,intoa criminal tribunal.— What has the numbeer of vtites cast in a particular election to do with ; the question whethera particular citizen is guilty 011 treason? Why should women, minors. orrihans, be deprived of their property iti consequence of the neglect of the citizens to vote? This extraordinary proclamation will britig no advantages to the negro race at all proportionlate to the obstructions it throws in the way of reunion.r It is, cer tain thatthe Union will never be restored till this ill, adviseal action of' the government is reversed. It converts every ibbabifant•of the South into a zealo., whose all is em barked in the success of the rebellion.— ' The idea that they will succumb to threats that they will vote on compulsion, that they will feel terror, or rnisgivings a or any thingtbut increased indignation at such a proclamation, shows small knowledge th ett e h s er ou o th fhu r to , amni mind. Ste i o e r a o a f t p h r e ocm of te ia mp a e i r i rn cannot possiblybe enforced, and its only effect will be to 'strengthen the determin• ation of the rebels to fight to the very is - last.as no T turning.hey areshut When the up i n ma powerilitary hich 1 1 1 h of the rebels broken we have laid be fore ourselves altask still harder `to per form. At the very crisis of the contest of, arms the President has reinforced them as effectually bad may d rn the f i r r o s r q n uad rots ne i i n es theour m - Their leaders will make of this proclamation e. a fi s i-rd They h . e will j) ice. their ehiefestmgal weapeon. It is power less in our hands for good; in theirs it will be potent for evil. Onr only salvation4s now i n t h e haliet•box. To that it yet re mains possible for the pebple to resort.-- There the battle l9st to day may be won to-morrow. There alone the insulted majesty of the Constitution may be yin dieted by tne people against its faithless eustodians.—A. P. World. All orders heretofore issued by the War Department, conferring authority upon other officers to act as Provost-Mar seals, except those who have received spe cial commissions from the War Depart meet. are herel y:revoked. By order of the Secretary of War, L. THOMAS, Adjutant Genera] Ala Urgent Appeal for Help. The Baltimore American, alluding to the terrible condition of some of our wounded and dying soldiers says : t is impossible to exaggerate the frightful sufferings now endured by thous ands within some sixty or seventy miles of this great city. Men are there—brave, noble-hearted, intelligent fellows—who hav e Corny into the State as its defenders, and who, since the great battle which has I.placed them helplessly on the ground, in their own Wood, have not been moved or assisted to any extent. put down my hand to feel of my hurt today, said ono bright, intelligent fellow to us, and I broUght it away covered with — maggots.' His wound had not been at tended to for -four days! Artithcr re: quested us to lift the blanket which cov ered his amputated limb • and a stench came from it almost unendurable. And yet they have to endure it.themselves, ly ing side by side ; whilst when they qie, as many of them do, hours elapse before the bodies are removed. We saw, in one case, where a- dead body altdost touched two poor fellows who were perfectly power less, even to turn over so as to get away from it. It had been there for twenty-four hours. These facts are not surprising un der the circumstances. Thousands upon thousandsare there r stables, orchards are full, everything that affords even the sem blance of shelter ; and let the regular sur geons and nurses do their best, they.are of necessity insufficient in number to attend properly to every case. — 41 Read Read !
