FRIDAY MORNING, AUG. 29 CITY AND NEIMORIIO9D INTELLIGENCB Habeas Corpus—Charge ofPrr jury. lPsterday morning, Patrick Carrigan, b.., was brought before Judges Ritchie, Sterrett and Adams, on an application for discharge upon a writ of habeas corpus, his father. Patrick Careioan, Sr., alleging that the boy had enlisted' in Capt. Pier son's Ililands Infantry without his con sent. The case was apparently a plain one, as Carrigan what he swore wus the record of his marriage, (in Toron to, C. W., dune id, lA I I.) and that of the birth ofhis son, (at the saute place, March 34th, .18-.) whieh latt:r he stated was made by the priest on the Sunday follow itnr, the birth of the child. The hand writing of both records was the same, ar.d looked quite recent. These facts gave rise to some anspicion, when, on investi gation, it was foiled that the title-pages of both' Old and New Testaments, in the bible containing the record, showed the date 1850, five rears later than the al leged birth of the boy and six after the marriage. This settled the matter so for as the recruit was concerned. and he was remanded into the custody of Capt. Pier eon. The elder Carrigan persisted that the record was made in 1845, and the Court ordered hint into custody for per jury. He gave bail for his appearance at the next term of Court. • The 139th Regiment off To-Day. — Tramsportation has been provided for Co!. Collier's regiment, and they will leave for Harrisburg at 4 o'clock this after noon. The men were uniformed here; they will receive arms and other equip ments at Harrisburg, and, it is expected, be sent on to Washington at once. Resisting- a Deputy Marshal. On Wednesday, John Shuinan, of Mif flintown, Juniata county, was brought to this city under iirresi, charged with resist ing the deputy (21. L. Guss. Esq., editor of the Juniata Sentinel) of the district, when he entered his house in the discharge of his duties. They are a splendid body of men, fully armed and equipped, at: o ready for active duty, equalling any yet furnished by Michigan. The otlicers are Colonel, W. H. Worthington ; Colonel, Constance Luce ; Major, G. Col lino Lyon. They were all provided with ti comfortable supper at City Hall by the ' Subsistenc4 Committee, and proeeeded on their journey to Washington city in the eve ning by Pennsylvania Railroad. Another regiment is expected to go through to-mor- row night. Organization of the littith flegimen t. On Wednesday, the 146th regiment, consisting of four companies from this county, viz: Capt,. Wright, Bayne, Lati mer and Seibert. Capt. Chapm an s, of Crawford; Capt. W. 1.. Smith's, of Damh in; Capt. Hill's, of Cambria; Capt. Morris, of Luzerne, and Capt. Phillips' and Ham monds, from Tioga, all enlisted for nine months, was organized ; with Capt. T. M. Bayne as Colonel and Capt. Isaac Wright as Lieut. Colonel, both of this county. The Major has not yet been named. There is material in Camp Curtin for three three years regiments, Arrested for Treasonable Lan guage. On Wednesday last Joseph Ilollar, of Manchester, was arrested and taken before flenry Sprottll, Esq., United States Com missioner, charged with uttering treasona ble language. After a further hearing yesterday morning he was finally held in the sum of to answer a charge of discouraging enlistment s at the next term of the United States District Court. The language constitutin g the offence is thus quoted: `• I will• not go to the war and they cannot make me. I would rather serve in the rebel army for five cents a day than accept the bounty." Trimble's Varieties. This popular place of amusement, wfi e h is now under the management of Mr. W. C. Smythe, is nightly drawing crowded houses. The performances given are really of a first rate character, and inure than worth the trifling sum demanded for ad mittance. This evening has been set apart for the benefit of Miss Fanny Den ham, an actress well and Ilivorithly known here, on which occasion a most excellent bill will be presented, including the pop ular buries pie of "Pocahontas," and Jenny Lind, the performance being interspersed -with singing and dancing by the Olio com pany. The Corcoran Regiment. A call has been issued for a meeting at John Duffy's corner Grant and Webster streets, on Saturday evening next, to take the necessary measures for obtaining authority to raise a regiment here for Gen. In all cases where the surface and the coal are owned by dijii:rent persons, the surface must he assessed to the owner or owners of said suifuce, and the coal must be assessed to the owner or owners of the coal, separately. The coal men say the Commissioners have no right to make such assessment and will make an appeal to the Courts. Theatre. ThP " Lady of Lyons'' attracted a large and iiishionable audience last night, and was received with unbounded applause. It was finely put upon the stage, and taking the entire cast, we do not remember ever having seen it better pr , duced. Mr. Chap lin was a most excellent Claude, evincing careful study and a tine appreciation of the text. Mr. Mordaunt's Beaassant, and Mr. Chippendale's Col. Dumas were very line. Miss Frost's Pauline was quite as clever us the majority of stars. Whilst nearly all of the 'Western Theatres, and in fact a majority of Eastern ones, have cut down their companies to the lowest possible e,taudard, Manager Henderson seems to have enlarged his, and secipTd the very best available talent. To-night will be presented the "Serious Family" and " Dick Turpin," a bill which will crowd the house: Buying Substitutes Before a Dralt. The following paragraph will have an unpleasant interest for many here who have secured, and others who are en deavoring to procure, substitutes. It may he well to use a little caution : " United States District Attorney Fla men Ball, in deciding the other day, at Cincinnati, the case of a person who had been obtaining substitutes for different persons liable to be drafted, expressed the opinion that any person actually obtaining and holding a substitute before the draft shall have taken effect, makes himself liable to arrest on the charge of dis couraging;enlistments." Killed on the Railroad. Obadiah Forshe, a young man, re siding at Millwood, was knocked down by the Fast Line on the Pennsylvania Rail road, Tuesday evening, and instantly killed, while walking on the track near Hillside, on his return from prayer meet icg. An inquest was hell, and a verdict of accidental death returned. Police Items. Robert and Jane Bateson, husband and wife, have been committed to jail by Ald. Miller, acting Mayor of Allegheny, for surety of the peace, on oath of John Brac nen. The same magistrate has also com mitted for trial one John Rinehart, on a charge of assault and battery, preferred by his wife. McClure to super intend the draft, says:—" The material for an immense force will be found to exist in every locality of the State. Having ascertained the number of men to be drafted from each subdivis7 ion of counties, an opportunity and rea sonable time will be given to furnish the qiiota as volunteers ; the draft was post poned to the fifteenth of September, to afford ample time for these arrangements. They were botlv pursued by Gent:ral Blunt, and driven in otter confnsion across the usage with the loss of all their transportation arid equip ments, besides arms, prisoners, &c. It is considered that the expedition saved thtt Missouri towns and border from devastation, beside's striking terror into the hearts of the enemy as fir as the Ar kansas line. General Blunt's column re turned to Fort Scott on the 22d, having marched neatly :tuft miles in six days. Col. They have abundance of pro visions for sixty days. Every few days our troops send out foraging parties, some times consisting ofa hundred wagons, into Powell's Valley, from which they in variably return loaded, the foragers al ways driving away whatever rebels they meet. The correspondent says the federals can hold the Gap against any force ; that the rebels don't mean to attack, but think they can starve the federals out.
