Irwin he was accommodated with boarding. Nothing unusual was noticed in his appearance un. til Sunday morning. Ho went into Wyeth's Crag store and asked for a bottle of strychnine, stating that ho wanted to employ it at Clamp Curtin, and would come in and pay for it as soon as he could go to the hotel. Not making his appear ance within a reasonable time, the drug gist went to look him, when he saw bim walking down the square, and on coming up to him he threatened to kill any person who attempted to take the bottle from him. Proceeding on, and arriving opposite Houser & Lochman's store, he fell, and shortly expired. Gen. Irwin was immediately sent for, who stated that the deceased was formerly a very wealthy cit izen of Lawrence county, but reverses in fortune had no d. , ebt preyed upon his mind until he committed the rash deed A coroner's jury was summoned, and a verdict given in accordance with the forn going facts. His remains were forwarded to his friends. TRIAL OF BREECH LOADIRG 1:1 i Llig On Saturday a series of experiments with Storm's breech loading, rifle was made at the Harrisburg arsenal, in the presence of Gov. Curtin, Chief Juvice Lowrie, Gen. eral Biddle, Gen. K.im, and a number of other military officers. The trials were made for rapidity of loading, enduram e and accuracy at long ranges. In these important requisites, and in simplicity, it proved its superiority over all other wua. pons of the same kind. It can be fired ten times a minute, and throw a th.li with accuracy the distance of a mile. For mounted riflemen, or cavalry, it is much superior to Sharpe's carbine, both in facili ty of handling and rapidity of loading.— The Governor and officers present expressed the highest satisfaction with the perform ante of the weapon. The policy of the governte slot in regard to employing foreigners in the military service is ea tell -, we the statement being made on geed authority: let—No one has been auteoriz id to en list or raise troops in Canada, as has been affirmed to be understood there. 2d.—No communications have been of. ; feted or other overtures made to military men in France or other European States, as has been 'assumed there. di—The government bas not tendered the command of the army to Genera: Garibaldi, use has been represented in Europe. What is true e: Ist. That every for eigner who has come with a good chsrac ter and credential, and offered his servis (iris t, the government for the support of the Union, has been accepted, and no other is in the military employment of the U. S. 2e. General Garibaldi being a nature elized citizen, it was reported to the gov ernment by one of our consuls that the General was contemplating il visit to this country, and that he had intimated confl, dentially a disposition to engage in the service of the United States He Was informed that if this was so his services would be accepted with pleasure, and he would roc eve a commission as erle,j9r Gen eral, being the same rank that was confer red on General Lafayette in the army of the revolution. General Garibaldi, upon consideration of the subject, concluded not to offer his services at present, but thinks he may, by and by revisit the United States. Brig. Gen. Graham appeared before Judge Merrick toe_ey to answer a emerge of con tempt of court in detaining the minor, Jeremiah Lyons, in the camp of the 23d Pennsylvania Regiment after the court had, under a writ of habeas corpus, ordered big release. General Graham answered by filing an affidavit and disavowing any In tention of contempt, cl timing that he acted in strict conformity with the law and lit erally obeyed the order of his superior offi. cer. In this connection he quoted General Order No. 73, emanating from the Adjt. General's office. It is dated September 7th and says ; Hereafter no discharge shall be granted on the round of minority. Gen. Graham's counsel argued teat the court has no jurisdiction in the case, it being one of a purely military character to be determined alone by the military au. thority, the power to discharge, being offi-' cially vested in the War Department. The court differed altogether from the argae meet, maintaining liah', undisturbed by the clamors of the multitude and sedulous.. ly guarding agdnat dangerous precedents, justice shoula be administered according to the constitution and the law; no political motives—no reason of State, nor plea of necessity could justify a disregard of the solemn duties of the judiciary. The power of discharging miners by judicial process, had been exercised in various States, not only during the war of 1812, but since the commencement of the present civil contest, and he, himself, had repeatedly exercised this jurisdiction, without any question being raised as to the propriety of his course. The solemn decision of the entire Supreme Count wes that the military cane not be exempted from subordination to the civi: tribunals and at no time can a military officer purge himself from an illegal act by quoting the order of hie su perior officer. Following the example of chancellor in the case of Commodore Chauncey and Gen. The Hon. John F. Potter, chairman of the Investigating Committer •,f the House of Representatives, on the ti . e inst. called the attention of the Navy to a statement in the newspapers that Capt. J. H. Morri son, of the steamer Fanny, recently cap tured by the rebels off Cape Hatteras, was imprisoned at Fortress Monroe for refusing to take the oath of allegiance, and inquires if the statement was true, in whole or in part. The Department today replied as follows : NAV!' DEPA.ItTMENT, Oct. 1). 18G1. Sat:—Your letter of the Bth inst., rel ative to the newspaper reports concerning the master of the steamer Fanny, has been received. The steamer alluded to was not, at the time of her capture, in the service of this Department and has never been employed by it, and the same may be said of her captain. This Department has no knowledge of him whatever and I have no reason to suppose that at the time of the capture of the Fanny a single person in any way connected with the Navy was on beard of her. Very respectfully, GIDEON WELLES. J. W, Grimes, of Georgetown, has been arrested on the charge of purchasing.gov ernment property of the 'Quartermasters, &c., which they had no right to sell. It is said that his books have been kept with such clear precision as to afford clear proof against the parties implicated. surrender ot a Federal Camp. JEFFICIISON CITY, Oct. 9 --The surren der of a federal camp near Hermann rew ported this morning, proves not to have been so serious an affair as at first stated. Colonel Matthews simply abandoned his caner on the approach of the rebels, and returned to Hermann without loss of any kind. Tire three cannons mentioned in a previous despatch belongedto the rebels. Harding' now telegraphs from Her mann that he has no apprehension of an attack on that and that the beacon• ade and Osage bridges are well guarded and secured against the rebels.
