Matthews etal; recetly decided by our District Court, have taken an appeal to the Supreme Court. The ruling to which the defendants object is that when the judgment bond contained an ex• press waiver of the benefit of any and all stay laws, the new law was an interference with a contract, ex post facto, and therefore, uncon• stitutional. file execution ordered in this case was "stayed" by the writ of error to the Sept erne Court. The case will probably come up for disposal at the fall term of the Supreme Court in this city. JUDICIAL NOMINATIONS -On last Saturday Democratic conferees from Washington, Fayette and Greene counties, for the purpose of nominating a candidate for President Judge of the judicial district composed of the coun• ties named, met at Beallsville The Wash ington county nominee was Judge Gilmore, the present incumbent, while Joshua B. How ell was named from Fayette and Jos. Lindsey, Esq., from Greene. The conference resulted in the nomination of the gentleman last named, who will run upon the regular Democratic ticket. Ix Canty.—On Tuesday evening the West Newton Guards, composed of men from Wash ington and Westmoreland counties under Capt. A. G. Oliver, arrived here and wont into Camp Wilkins. This corpse is composed of respectable, staunch and able bodied men, who have volunteered to serve their country from a sense of duty and patriotism. They are establuiLed at the quarters formerly occu pied by the Pittsburgh 8, - flers, and have fitted them up with.many comforts, that make the lose of h..01e and home conveniences less ap parent, and at an expense of over one thou• sand dollars they have been completely equips ped by their friends, and will favorably - com pare with any company in the service. KILLED COAL PIT.—On Wednesday afternoon, David Moses, a coal minor employ ed in the Oak Hill pit of the L'ttle Saw M:11 Coal Company, was caught by et falling mass of coal and slate, and though be attempted to escape, was terribly crushed; his body being compressed, several ribs and one leg bro ken. He was removed to his residence on the Washington road, in Temperanceville,and died daring the evening. He was an Indus. trious workmen and leaves a wife but no chil dren. Colonel Kenly, the Provost Marshal, waited on the Mayor and Police Lominissionerii. The latter asked time to consider, but the Colonel told them that his orders woro immethate, and he proceeded to the Marshal's office, talting pos session. The Commissioners then directed the police officers to obey the military authority, and declared their intention to prepare a pro test against the action of the government. At three o'clock this morning, George P. Kane, Marshal of Pollee, was arrested at his house, by order of Gan. Banks, and conveyed to Fort McHenry, where he is now held a prisoner. General Banks issued a proclama tion naming John A. Kenly, of the Maryland regiment, Provost Marshall, superintending also the powers f the Police Commissioners, and who is to exercise supreme control over the Department until some knowt, loyal citi zen if appointed to act as Marshal.
