The Court met at ten o'clock.
HOMICIDE TRIALL.—The ease of the Common
wealth vs. Edward Mullen and Bernard Lafferty
—lndictment manslaughter, alleged to have been
committed to driving a coal wagon over the body
of James Hays, an old gentleman of Temperane
vale, who died from the effects of the injuries he
ansmined, was taken up. Bernard Lafferty had
never been arrested, so Edward Mullen alone woo
on trial. A jury woo empannelhd in the using sol
emn form, and thenrisoner, httiing been arraigned,
pleaded "net guilty". He Is a grime and miller
good looting man, apparently about twenty five or
pi: years of age.
Colonel 8 W. Black appeared for tho Cam
ram/wealth—J. D. Mahon Esq. for the Prisoner.
Before the ease was opened, his honor, Judge
McClure remarked Unit there had hitherto been
too much noise I n the court room during trope,
tent trials. The defendant was charged with a
very serious crime, and it was importantthat every
word of the evidence should be dikiinctly beard.—
Persons could remain silent in church—lt was at

Court.

eloquent style. He stated the law upon the subject.

He eoneluded by citing a number of cases in
support of his opinion. It would be proved that
the detendant and other persons had hero ra
cing, and while their horses were at . the top of
their speed the deceased was knocked down, and
his skull fractured.

curred. A neighbor woman, named Blair came in
