The trial Of the Street Preacher. was resumed
this morning. •
Testimony for defence continued—
W. W. Wallace, sworn.—Live a square from
where the Penn street meetings are held; have
been at them trquently; lacier saw any obstruc
tion of the street; saw vehicles passing at a trot,
heard filthy language rend from books. Den's
Theology was one 'of the books he frequently
quoted.
Mr. Kirkland arose and spoke far some time,
until the Court ordered another Witness to be
called.
Mr- Kirkland then ofrered the books in evi
denge.
The Court said that the fact thatthe hooka can.
tattled filthy:language was no justificution to the
defendants, and refused to receive the hooka.
The witness (Mr. Wallace) was asked whether
he had ever contributed to the support of the de•
readapts. The question was Objected to, and the
objection overruled. The witness then said he
•had bought their paper, but did nothing more.
Joseph Bowman, sworn.—There was no oh
struction to the street by theme meetings
Samuel Berton, awom.—Am proprietor of an
omnibus line; have 'never been obstructed by
these meetings; my otnnibusseg run through Mar
ket street; I drive myself.
Mr. Perry, sworn.--(Mr. proposed to
prove by this witness that he had heard the. lan
guage used by Barker & Co., in other places. This
testimony was overruled by the Court.)
Mr. Cameron, sworn.—Have seen : disturbances
at the meetings, raised by drunken men, whoume

Reichelm, sworn.—Have driven through
these meetings With a buggy, and was never ot•
strutted.
Dr. Dike, •worn.—Have passed through the
meetings; was never ohstroeted by them.

meetings for the purpose of raising fights.)

Samuel Weans, sworn—Has ratended these
meetings in the Diamond ; the crowd occupied
three fourths of Market street, In front of the speak
ers; had on one occasion seen the street entirely
tilled by the crowd; peosons would have difficulty
in passing through; heard bad language used by
Barker, by not by the others; heard Barker speak
obscenely of the priests, the sisters of mercy, •
member of the bar, and other cameos. (The wit
ness detailed wile of the expression.) Had seen
other meetings itt the Diamond, butilarker's were
the largest crowds

meetings in the Diamond; the passage seas ob
structed; has heard Bariier making obscene quo

of the meeting, on the Canal Bridge; beard Barker

Andrew Scott, eworn-4-Lives in the Fifth Ward;
has been at meetings on the Canal Bridge, the
street was obstructed; heard indecent language
from the speakers.
Mr. Kirkland here called seversl of his witness
es to prove, as he'before stated, that he had made
arrangements at his meeungs to keep the street
unobstructed. The Witnesses were not present.
Mr. Magma , then proceeded to give reference
to several authorities:
. Mr. James K. Kennedy then addressed the jury
in a short speech, for the prosecution.
Mr. Ertel., fur the defence, then 'addressed the
jury at some length, and in a well argued and in
genious speech.
Ile was followed by Mr. Brady, who made a
long speech, arguing the illegality of the last count
Of the Indictment, end contending that the charge
of nuisance in the two first counts was not made
out. He quoted a variety of English authorities in
aupport of the position which •he assumed. • •
Mr.Magraw then cloned for the prosecution, in
a speech of shout no hour in length, 'which was an
eloquent, plain, common sense argon:lento:lqm the
law and the facts of the ease. It was one of his

The lint and second counts of the indictment
charge a nuisance.
There is nothing better settled, than that every
unauthorized obstruction of a street or highway, is
a nuisance. It is no matter whether the °bennc-.
non be a partial or total obstruction--it is still a
nuisance. The citizens of the Commonivealth
have a right to a Gee passage through the public
highways. Any obstruction which makes the
passage lees commodious, is a nuisance. It has
been expresnely held in our own State, that it is
a nuisance in a constable, or an auctioneer, to bold
his sales on a public greet. How much more
would it be a nuisance in a religious or political
fanatic to hold meetings, night alter night, in the
most public thoroughfarei of the city, bringing to
gether large crowds of men and boys, extending
at times entirely across the street, using on each
occasions the most obscene lumbago—. whose
whole discourse and conduct ore calculated to ex.
cite the worst passions--to array one portion of the
community against another—to traduce the most
worthy and prominent people of the place, sparing
neither age nor sex—and whose prcceeding. have

public pence.

name of religion..—The Christian religion Menthes

efficacy to these great . principlei of Christianity, by
proclaiming the do,:trine of toleration, and provi
ding that no man shall be molested on account of
his religious tenets. The Constittitiim securer, or
was intended to secure, to every - citizen the free
enjoyment of his religious opinions. He virtually
sets the Constitution at naught, and virtually •ins
fates us provisions. who in a *pint of fanaticism
or intolerance, makes the creed of a large portion
of his fellow citisens the groqad of daily and
nightly indecent attacks upon them, both in
their personal nod -religious relations, before I
crowds of men and lays, on the public grimts of
the city.
The defendants had just as much right to erect
a slaughter house on the pavement or street, as to
hold meetings there, night after eight, to the ohs
siruction of the high way, and under eireurnatan
cc* that rendered these meeting. an open outrage '
on decency, and thus calculated to deter orderly
citizen. and female. from passing that way.
Where s wagoner occupied one side of a public
street in a city, before his warehouses, for an in
convenient length of time, and had one wagon
standing usually before his warehoupee, so that no
carriages could pass on that side of the street, and
sometimes even foot passengers were immtamos
ded by cumbrous goods lying on thoground ready
for loading this was held to be a public nuisance,
although it appeared tout there was room for two
carriages to prise on the opposite side of the tercet.
A man weighes a log entirely across the street.
The log is the nuiunce, and the man who_ put it
there is responsible for it, and punishable.
A man brings a crowd together, and the
crowd block. up the simnel. The man by hisdis•
coarse and conduct shapes the character of the
assemblage, and they all become neissrussa togeth
er, and, if:the authorities saw St, might .all be
prosecuted together.. It would not; however, be
the milky of the law to proceed, against those
who are drawn there oicasioually by • feeling

law. Nor can they, by such a course, deprive
their neighbors of their rights. A disorderly
house, where men and women revert to indulge
In lewdness. intemperance and gross immorality,
to the nightly allauyanta and-disturbance of the
neighborhood, is a palpable nuisance. Will it be
any the less so, if some of the inmates or fre.
' queerer. of that home coma into Court and say
they do not regard it as a nuisance?
Reference has been made to merchants, who
have their boxes - on the streets—to polities
meetings, held on the streets, and to religious'
assemblages. A merchant 'may keep his boxes
before his store door long enough to remove
and assort their contents. If ha periling, them
' to remain for a length of time, to the obstruction
ol the passers by, it is a nuisance ; and It the
public permits them to remam, it is nothing
more than a temporary concession on the part
of the publio, and an omission on their part
to apply the remedy provided by law.
The same remark applies to political meetings.
They are held occasioaally for a period of st few
weeks In a year. Although violent language is
often need on each occasions, and an unnecessary
degree of excitement is Olen produced, it is not
the practice of the political orators to indulge in
obscene and greasily indeceat language. Nor does
my thing occur on ouch ...ions-calculated . to
subvert the morals of the community, or to make
the meetings an cottage on public decency. They
ore held fosin proper motives, and for the discus
sion of tomes proper for the information of the peo
ple. Still, they ace held in violation of the rights
of the community, if they block up the street.—
But the people are willing to tolerate them, became
they lest but for a short period, and are totally dif

it does not charge the use fif Indecent words on •
single pirticular occasion ; but such an habitual

morals of the community, and become an open
entrap on public decency. It tom therefore, not
necessary—it was not possible,.in Gaming the bill
of indictment to give the wool. It would require
superhuman efforts to repeal the expresaimas of a
Man whose throat was a common sewer of ob
scenolanguage-i-who never opens has mouth but
to usdace his neighbors with indecent epithets,
and, net content with prows opportunities, brings
together large assemblages, in order that hp may
scatter his filth is far awl wade as possible. It is

public peace, or of nuisance, or .andal in the
community, or partakes of the character of per..

injurious to public morale, or mischievously affects

in profane swearing—to be guilty of open drank
enneso—to cast a dead body into the river without
the rites of Christien sepulture-1u be guihy of
evesdropping, grid mom , other net iejarious to the
public monde—to public order or to public deceecy,
is an indictable offence. The further we depart
from these precedents, the higher we raise the
good gates of vice, immorality, and crime.
The id arty Of speech does not strike us a. be
ing at stake in: thus case. The question rather
seems to be whether there is power in the law and
the nubile authorities to preserve the peace and
morals of the commodity. That question most be
settled by the /try, and it is to be hoped that their
verdict will 1w in accordance with the law and the
facts, .d will be such a verdict as will promote
the .use of good morals and public order.
=After the Jory were charged, they retired to
their room, Red the Court proceeded with the trial
of a small assault and battery ease, after which they
adjourned until this morning, the dory not having
agreed and the counsel on both sides agreeing that
the Jury might bring in a scaled verdict In the
