In our paper of yesterday, we reported at length ;
an argument in the Court of Quarter Sessions, re.
lades to the case of Matthew A. Black, chars•'
ed with the murder of the negro Sounded The
question as to the power of the Court to take bail
was very lengthily argued by Mr. Staunton, and
closed by a written otatement from Mr. Siglam, the
Attorney General, stating that it was not the imeu•
Lion of the Commonwealth to ask for n conviction ,
of murder in the let degree.
This settled the question of the discretion of the.
court—bail being a right guaranteed by the con
stitution in all cues except in felonies of death.
We understood that the counsel for the defence
mere desirous of making an arrangement with the
counsel for the Commonwealth to take the depoai•
dons of the witnesses out of the slate, as they
could not be compelled to attend, and the court
had no power to make any order in the premises.
The Counsel for the Commonwealth refused this,
stating that they had the testimony of credible
witnesses as to the whole facts, and that the wit.
