The constant rain daring yesterday rendered it
exceedingly unpleasant for out door business. and
a general dullness prevailed in almost every
thing.
Receipts by river wane Saturday, 1111 shown by
our import hat, were quite fell, and considerable
animation wan manifested along the wharf
The river is again on the me with some S fort
water in the channel, and all clones of steamers
continue their regular trips from thus point to ports
below.
FLOUR—A few small lots were received by
river yesterday, but very little wes dose in first
hand sales; we quote at 3,90 p bbl. From store,
sales were regularly effected m dray load lots 'at
4,1004,0 p bbl. Salve are confined entirely to
the regular city trade, and supplies, although light,
are about sufficient to the deinrind.
GRAlN—Receipts have been to a fair extent,
but sales have been confined to limited lots only at
the following prices:—Wheat 75, barley 57058,
rye 5055, corn 33335, and oats at 27a28c per
bushel.
GROCERIES—No material change is the mar
ket. in sugar and molasses the market is not so
firm. We quote regular sales of the former at Se
by the hhd, and Ste by bbl; of the latter we note
sales in limited lots at 9.9a30e p gall. Sales 2.5
sacks Rio coffee at 71; of 18 at 7}e p 18, which ore
about the present ruling figurer of the market—
Sales of loaf sugar, St Louis relined, at a range of
Bto 10e p lb, an quality. Sales of riee at 4is
Sc f lb.
PROVISIONS--The market in dull, but prices
show no material change. Western cured bacon
is bold in regular liMited lots at, for shoulders 3-i to
4c, sides at 41211 c, and hams at 61061 c p

CHEESE—The market to without any matenal
change. We continue to quote good common W
Rat 5//4 1 51 . , and cream at Nadia y t.
FRUIT--Considerable quantities of green ap
pies are a.rriving by river, and supplies era quite
full. We note sales m a general way from store
at 1516310 p bbl, and from first hands at 75(d87c
bbl Sales of dried peaches at 81,12 601,18,
and of apples at 502t2c p bu.
RAGS—We note regular sales from first hands
of a good mixed article at 3c. p
FEED--Sales of bran at 10812 c, and of Aborts
at a range of 1.4 to 22c p ho. Supplies Cam
HONEY--.Sales from mom by box at 15e per
pound.
FISH--Sales of salmon in a regular way to the
trade at 319 p bbl, of mackerel No 1 at 11,500
512; and at No 3at 5,75036 g. bhl. Sales of her
ring at 375'636, and of cod at 4,50 p drum.
Multi Carat--The Collector gives [1041,0 thst
the water will be drawn out of the Allem. Canal,
below Daytou, on Dec. 25th. (C'hrwtmas day.) It
will be out for some time, as there is an aqueduct
to build, and a large amount of cleaning to be done.

Tax GONDOL - Ml—This boat, it was stated in a
telegraphic dispatch a few days since, was sunk nt
Preston's landing on the Mississippi by corning in
collision with the Josiah Lawrence. The latter
sustained no injury. The machinery and upper
works of the Gondolier will be saved: but the hell
cannot be raised, and the largest portion of the
cargo will be greatly damaged, if not entirely lost

STUSBOAT Cosa—A ease of no Rule interest
has just been decided to the supenor court of
Cincinnati. Judge Johnson presiding. Some two
and a half years ago, the steamer Yorktown in
auempting to effect a landing in the midst of a
dense kg, ran into and sunk a dat boat, which was
lying to, near the mouth of St Francis neer. Suit
was brought against the owners of the Yorktown
for some 33,000 damages. The jury gave a ver
dict in favor of the defendant.--(Cuo. Gas.
ASLICIICAN Chtiutuen--The Mobile Herald says
that since the destructive hurricane in Cuba a few
years since, the Mobile fruit market hen been sup
plied chiedy with Creole oranges raised in that
neighborhood, Pascagoula and on Else -coast" near
New Orleans. These me generally. larger - than
those raised in the neighborhood of Havuina, and
much superior in flavor. The Herald contends
that a number of loratioes might be selected on the

fondants are Robert Vance, Charles Lindsay. Geo.
Cannon, William Thompson, Gee. W.Gungle,Rob
inson Maniford, Washington M'Kelvey, Samuel
Sprague, Joanna Brown, Miranda Hollander, Tho
mas Love, Arthur Kirk,
aTheCourt enquired who were engaged as coon
sal for the defendants.
Mr. Black replied—The whole-of the liar, and
one or two other* from Mercer.—( Laughter.
The defendant, Thomas Love, who was last
week released front confinement, on account of
aickness, died yesterday morning.
Mesas. Shaler, Staunton, Bigham, and Callan,
were counsel for the prosecution.

Sawyer, Kennedy, and Snowden.
A motion was offered by Mr. Sheller to enter •
neile proserpir in the cases of James Micelvy and
Samuel Hughes.
Mr. Black objected, on the ground that the in•
dictment was informal that the other defendants
had a right to avail themselves of any informality,
and that by the course proposed they would be de'
priced of that right.
The objection was overruled, and a none pros
aqui was entered.
In the case of Creo. Cannon, Mr. Darragh moved
an abatement, on the ground that he was indicted
by a wrong name--his name being Kenan. The
defendant was a stage driver, and was not in town.
Mr. Darragh, however, appeared for him.
Mr. Black• moved to quash the indictment in the
oases of Robert Vance and Charles Lindley, on
the ground that they were not described as being
Yeomen,' which he contended was a fatal de-
feet. The female portion of them were properly
desenbed as 'Spinsters,' but the mules were not
described at all.
His honor observed that the description bad al
ways been regarded as neceuttry.
Mr. Shaler had no doubt about the correctness
of the motion. The females were properly descri
bed, bet he did not know whether the court could
quash an indictment In part or not
Mr. Stanton thought the court could not quash
the indictment, in reference to one and not in refe
rence to the whole. •
The court observed that the exception was a
good one; and they would suggest to the counsel
lot the commonwealth, whether it would not be
proper to proceed against those persons who were
properly described.
The court then adjourned till two o'clock, to give
the counsel time to consider the course they would
pursue.
Mr. Darragh amid it was contended that the in.
dictinent was good as to pert, and bad as to pert.
Mr. Shake, no we consider it good altogether.
He had looked at the ease referred to in the morn•
mg, and believed there was nothing in it. He ad
mitted that the court could not sustain an indict ,
meat to part and quash din part.
The court said Mr. Darragh might rain the
question on a plea of abatement, bat they doubted

Mr. Darragh read authormes to show the court
had power.
Mr. Black addressed the court in favor of his
motion to sash the indictment, and cited amt..
