FLOUR—A few small lots were received by river yesterday, but very little wes dose in first hand sales; we quote at 3,90 p bbl. Salve are confined entirely to the regular city trade, and supplies, although light, are about sufficient to the deinrind. GRAlN—Receipts have been to a fair extent, but sales have been confined to limited lots only at the following prices:—Wheat 75, barley 57058, rye 5055, corn 33335, and oats at 27a28c per bushel. GROCERIES—No material change is the mar ket. in sugar and molasses the market is not so firm. Cannon, William Thompson, Gee. W.Gungle,Rob inson Maniford, Washington M'Kelvey, Samuel Sprague, Joanna Brown, Miranda Hollander, Tho mas Love, Arthur Kirk, aTheCourt enquired who were engaged as coon sal for the defendants. Mr. Black replied—The whole-of the liar, and one or two other* from Mercer.—( Laughter. The defendant, Thomas Love, who was last week released front confinement, on account of aickness, died yesterday morning. Mesas. Shaler, Staunton, Bigham, and Callan, were counsel for the prosecution. counsel for the defence—Mesas. Black, Darragh, Sawyer, Kennedy, and Snowden. A motion was offered by Mr. Sheller to enter • neile proserpir in the cases of James Micelvy and Samuel Hughes. Mr. Black objected, on the ground that the in• dictment was informal that the other defendants had a right to avail themselves of any informality, and that by the course proposed they would be de' priced of that right. The objection was overruled, and a none pros aqui was entered. In the case of Creo. Cannon, Mr. Darragh moved an abatement, on the ground that he was indicted by a wrong name--his name being Kenan. The defendant was a stage driver, and was not in town. Mr. Darragh, however, appeared for him. Mr. Black• moved to quash the indictment in the oases of Robert Vance and Charles Lindley, on the ground that they were not described as being Yeomen,' which he contended was a fatal de- feet. The female portion of them were properly desenbed as 'Spinsters,' but the mules were not described at all. His honor observed that the description bad al ways been regarded as neceuttry. Mr. Shaler had no doubt about the correctness of the motion. The females were properly descri bed, bet he did not know whether the court could quash an indictment In part or not Mr. Stanton thought the court could not quash the indictment, in reference to one and not in refe rence to the whole. • The court observed that the exception was a good one; and they would suggest to the counsel lot the commonwealth, whether it would not be proper to proceed against those persons who were properly described. The court then adjourned till two o'clock, to give the counsel time to consider the course they would pursue. Mr. Darragh amid it was contended that the in. dictinent was good as to pert, and bad as to pert. Mr. Shake, no we consider it good altogether. He had looked at the ease referred to in the morn• mg, and believed there was nothing in it. He ad mitted that the court could not sustain an indict , meat to part and quash din part. The court said Mr. Darragh might rain the question on a plea of abatement, bat they doubted Whether they bad the power to quash the bill. Mr. Darragh read authormes to show the court had power. Mr. Black addressed the court in favor of his motion to sash the indictment, and cited amt.. He showed, at length, the ditterence between • plea of abatement. and • mobs in to quash.
