A. L. Pierson, of the llilands InfantrY, and his discharge was asked for under the law prohibiting the en listment of minors, without the consent of pa rents or guardians. The father of the boy was examined under oath, and testified that his son was under age, having been born in 1845. He also produced a copy of the Catho lic Bible, in which were the following records: "Patrick and Mary Carrigan were married June 3d, 1844, in Bt. Patrick's It. C. Church, Toronto, Canada West." "Patrick Carrigan was born, Marsh 14th, 1845, in Toronto, Canada West." The latter purports to be,' the record of the birth of the young man whose discharge was asked for, and the father swore . positively that the record was made by the priest, on the Sunday following the birth of the child. This evidence seemed conclusive, and per haps would not have been questioned, had it not been for the fact that the records of the marriage and the birth were made in appa rently the same hand, by the same pen, and with the Rattle ink—the whole presenting the appearance of having been recently executed. This lad the Judges to scrutinize the mat ter closely, and on tensing to the title page of the Old Testament, they found the date of its issue to be 18501 The same date appear, on the title page of the New Testament. Here was a most damaging fast for the case of Mr. 'Carrigan, and one which was wholly irrecon cilable with hie oath. lie did not attempt to explain, but with dogged firmness repeated that the priest had made. the record on the Sunday following the birth of the child, In 1845;1,1111e the Bible was not printed till 1850. • Carrigan was ordered into custody for per jury, and gave bail to answer at the next term of tout. The young man was remanded into the custody of Capt.
