Yesterday, in the Court of Quarter Ses
sions, Judge Mellon presidiet, the cue of
William Yeach, indicted for nnisance, wu
called up for trial. The indictment charges
that the defendant, who is proprietor of hog
pens and cattle yards, is the Second ward; Al

consequeuce of the noisome stenches and un
wholesome smells which said hog pees emit in
the neighborhood.
S. Scholar, Jr., appeared on behalf of the
prosecution, and Messrs. Hopkins and Hamp
ton for the defense.
_ may be proper here to state that the yard.
or pens of the defendant are incited at what
are generally known as the ginattle yarde,"
where the hogs, cattle, bones, etc , arriving
by railroad from the West, are delivered,
housed, fed, and sold or reshipped. There
are severs/ other yards in the nine locality,
where bog, and cattle are kept. These yards
have been need there for many years, but lat.

yards is of such a character as_to greatly an

of the railroad, and that their present location

Since our last annual meeting the direful
confusion of a nation arming itself for civil
war, has, in a measure, deadened all other
sounds, and the suffering women and little
children that, known to as individually, made
a long array of wants and aorrows, c iieem but a
handful in comparison to those, who by the
prostration of business all over the country,
are now pensioners on the bounty of a favored
few. II time allowed, and the story of Potters
ty were not so old—older than the law that,
five thousand years ago, demanded that the
sheaf should he left in the field, and the olive
and the grape angleaned, for the widow and
the fatherless—we could tell of homes forlorn
and cheerless, where sorrow, not coming alone
is bereavement and orphanage, has in its train
sickness more hopeless and palatal than we
often see where food is wholesome and apart
ments comfortable, crippled Bogen that mast
earn daily bread, poor idiot chill:tree, and lin
gering consumption without the alleviations
en has discovered pure air to breathe.
II we mild, in faithful colors, lay before you
the mitaile of the past winter we know that
from the fielde of armed men, and the sounds
of disunion and strife, many sympathies and
"material would be recalled to those at
oar own doors whose lives are sustained by ■
continual warfare against daily recurring
want. And if we waste some charity and find,
as we often do, indolence and ingratitude was

Col. Hick'. report of the Leesburg battle,
published bere for the first time this morning,
creates some atonement. His estimate co our
loss (over nine hundred mos) ie g than.
the Wit Department has acknowledged at any'
time, bet officers who ware engaged in the
battle fed understood all the facts, amen that
Colonel Hank's estimate is coder, rather than
over the mark. It also appears that the troop.
under Colonel Baker were thrown into a lent.
penny panic by the death of their leader and
the ambush into which they were led, and re.
treated precipitately towards the river. This
ligrees - perfectly with facts long ago_in the
hands of newspaper men here, bat which were
'withheld from publication for fear that the gov
ernment would complain. ifio far as the con-
-duct or the government is concerned in the
temporary suppression of the facts in thie af
fair, it memos that gill's Vary outset the Print
deal and Cabinet and our leading military
men were fully acquainted with the worm
fact, out as they, came by , telegraph and were
gathered in a moment of ezeitement they were
not credited. It was, therefore, not Po much
'because the government wished to conceal
the fact. from the people that the order wee
given prohibiting their utusmiaaioe by . tehe

Washington City, Oct. 31, 1861. j
To the Hon Simon Cameron,

Sir: For more then three year( I have been

more than a fii`w rues it a time, cad that with
mach pain Other and new infirmities, drop
sy and vertigo, admonish me that • repose of
mind and body, with the appliances of Sal ,

little more to a life already protracted much
beyond the usual span of man. It is under
such circumatancee, made doubly painful by
the unnatural and onuat rebellion now raging
in the Southern State. of our so late prosper.
i
our and happy 1 .1 'ion, that I am compelled to
request that my me be placed on the list of '
army o ffi cers rate d from astir* service. As
this request is too ded on an absolute right,
granted by a recent act of Congress, I am en.
ttrely at liberty to say that it is with deep re
gret that I withdraw myself in these momex..
Lou times from the orders of a President who
has treated me with distinguished kindness
and courtesy—whom I know, upon mush per
sonal intercourse, to be patriotic, without set.
tional partialities or anodise'', to be highly
conscientious in the performance of every
duty, and of unrivalled activity and perseve
rance. And to you, Mr. Secretary, whom 1
now officially address for the last time, I beg
to acknowledge my many obligation, for the
uniform high consideration 1 have received at
your bands, and have the honor to remain,
Sir, your obedient servant.
(Signed:) Wllittttri SCOTT.
A Imolai Cabinet meeting was convened on
Friday morning et nine cealook to take the
subject law consideration. It was deelded that
Gen Eloott'a request, under the Oircumstances of
his advanced age and Infirmities, would not be
declined. Gen. McClellan was thereupon, with
the anon - mous agreement of the Cabinet, noti
fied that the commend of the army would de
volve upon him. At four o'clock in the after
noon, the Cabinet again waited upon the Presi
dent, and attended him to the residence of Gen.
Butt. Oa being seated, the Pranideut read to
the General the following order: Oa the Ist
day of November, A. D 1861, upon his own sp.
plioation to the President of the United States,
Brevet Lieutenant General Winfield Boott is
ordered to be placed, and hereby is platted, upon
the list of retired officers of the army of the
United State, without rednotion in his current
pay, subsistence or allowances. The Americas
people will hear with sadness and deep emo
tion, that Gen. Scott has withdrawn from the
active control of the army. While the Pres
dent and the unanimous Cabinet expose their
own and the nation's sympathy in his personal
affliction, end their profound sense of the im
portant public cervices rendered by him to Ma
country during hie long and briiiiint career,
among which will ever be gratefully distin
guished, his faithful devotion to the Constitn
ttoo, the Union end the Flag when assailed by
a parricidal rebellion. (Signed)

Gan. Scott thereupon rose and addressed
the President and Cabinet, who had also risen,
as follows:
President—Thai honor overwhelms me. It
overpays all the services I have attempted to
render to my country. II I had any claims
before they are all obliterated by this express
lion of approval by the President, with the
unatiimeue support of his Cabinet. I knew
the President and this Cabinet well. I know
that the country ha. its interests in this trying
crieds in safe keeping. Their counsel. are
wine; their labors are untiring as they are
loyal, and their coarse is the right one. Presi
dent, you must excuse . me, Intl unable to
stand longer to give utterance to the feeling,
ol gratitude which oppress me. la my retire
ment, I shall offer up my prayer to God for
this Administration and for my codetry. I
shall pray for it with confidence in its success
over its enemies, and that cpeedily.
The Pi . ..indent then took leave of Gen. Scott,
giving him his hand, and nying that he hoped
coon to write him a private letter expressive
ol his gratitude and affection. The President
added General, you will naturally reel soli-
Cantle about the gentlemen ni your staff who I
have rendered you and their country such
leithlui service. I have taken that 'abject in
to coninderatirot. Priuddifitand that they go
with you to New Tork. Isbell desire them,
at their earnest convenience alter their rearm s
to make their eirthee known to me. I desire
.you, ,however, to be sunfied that, except the
unavoidable privation of your counsel and
Society, which they so long enjayed, the pro
vision which will be made for them will be
each ae to render their situation as agreeable
hereafter as it has been heretofore.
Each member of the Administration:then
gave his hand to the veteran and retired in
profound silence.
The Secretary of the Treasury and Secretary
of War will accoraptuy Gen. Scott to New
York to-morrow by the early train.
