The indictment charges that the defendant, who is proprietor of hog pens and cattle yards, is the Second ward; Al legheny, keep, and maintain, a nuisance, in consequeuce of the noisome stenches and un wholesome smells which said hog pees emit in the neighborhood. S. Scholar, Jr., appeared on behalf of the prosecution, and Messrs. Hopkins and Hamp ton for the defense. _ may be proper here to state that the yard. or pens of the defendant are incited at what are generally known as the ginattle yarde," where the hogs, cattle, bones, etc , arriving by railroad from the West, are delivered, housed, fed, and sold or reshipped.
