"The burden was upon the claimant to establish by compet j ent and convincing testimony that while engaged in the service of the de j fendant, the claimant's deceased hus- I band suffered a personal injury of I such a character as to be the proxi- i i mate cause of the subsequent death," | i says he, "and that the line of causa- : tion between the accidental injury, if fully made out, and the death follow- j ing must also be unbroken. This bur den in our opinion has not been met i by satisfactory testimony in the rec-1 cord. There is no direct evidence, oth- i er than hearsay, as to the happening' of a serious injury nor are such facts! clearly established from which a safe inference can be drawn as to the oc currence or nature of the possible in jury sustained." The widow of Louis Witte, high con stable and special police officer of ' Ellwood City, who was also employed as a bartender and hotel man in a tav ern in that borough, has been awarded compensation for the death of her husband as the result of a shot fired by A. P. Lyons, a guest at the hotel where he worked, and the landlord must pay tlite compensation according to i|nother decision handed down to day by Mr. Scott. The opinion says that Witte's duties as borough con stable did not pccupy much of his time and by agreement of the borough authorities he was permitted to ac cept employment in the hotel, the bur gess reserving the right to call him from his employment at any time to perform the duties of a borough of ficer. The opinion expresses the thought that the hotel owner em ployed him "with the thought at least, that he could use him to maintain or der in the bar room and on the hotel premises by reason of his being a special police officer." It is held that ' HARRISBURG TELEGRAPH when Witte went to the room of Ly ons, who was making trouble, he was "not hired as a special officer ex clusively to preserve order nor did he go to the room ot' Lyons at the sug gestion of the burgess. He was simp ly called by his employer during his regular working hours as a bar tender to look after a disturbance in the hotel." The opinion states that Witte could not be shifted from the position of employe to that of public officer at the will of his employer. It is also held that the shooting was the result of an attack upon Witte as an employe who was endeavoring to quiet an ob streperous guest and not on any per sonal grounds. The Board has dismissed the appeal in the case of Shepherd vs. Schlegel, a Heading case, on the ground that the testimony was hearsay and in the case of Captanelli vs. Jefferson and Clear- Held Coal and Iron Co., a Jefferson county case, on the ground that the injury alleged was not suffered in course of employment. C., Feb. 2.—The aid of the Federal Government to prevent the passage of enforcement of alien land laws by Idaho and Oregon, which would prevent Japanese from acquir ing property in those States, was asked of the State Department by Ambas sador Almaro Sato, of Japan, who call ed on Counsellor Polk. No "pro test" was presented, it was explained in Japanese circles, but the gravity of the situation, in connection with the situation in California, was impressed on the State Department. No concealment has been made in Japanese diplomatic circles of the fact that Japan has not dropped the ques tion of the antl-alien land laws in California, or of that country's inten tion to take up this subject in an ini pj-essive manner with the State De partment when the conclusion of the war may give it opportunity. Japan Is known to feel strongly on the sub ject, and to be prepared to go deeply into it with the United States Gov ernment when its shoulders are re lieved of other burdens.
