Brown Hands Down Another Opinion on 50 Per Cent Clause In an opinion handed down to-day Attorney General Brown decided that though Uriah P. Rossiter received more than one-half the total number of votes cast for that office, yet not having received more than one-half of the total "number of ballots cast within the political district," tha county of Erie, he la not entitled to be certified as the sole nominee for the office of judge at the general elec tion in November. Judge Rossiter re ceived a majority of the votes oast for judge in Erie county, but less than one-half the total number of ballots cast and the attorney general decides that in this instance the 50 per cent, clause must be construed as moaning more than one-half the ballots. This is a construction of the law as it relates to the nomination of but one judge in a district.
