It is that no person or cor poration bas tbe right to place a pole in front of the property of any owner with out first having obtained bis written con sent, or having paid bim for such use. The judge holds tLat oral consent, or the fact that the property owner stands by and witnesses tbe planting of the pole without protest, does not satisfy the law There must be a specified written contract or proof of payment. Here is another in terpretation of agrarian rights tbat will vex telegraph, telephone, electric light and trolley companies, in Ohio at least, It is simply au Indication that many cor porate "rights" generally submitted to have no legal existence. They must lie served personally and the shoriff is not entitled to the mileage he holds. The tie cision comes on a test instituted by Sher iff McElhinney against the Venango county commissioners, to compel them to pay to him at the rate of 10 cents per mile for serving subpoenas on jurors. In sev eral other counties of the state this mile age is allowed to the sheriff. Heretofore jurors bave been served by mail In Ve nango county. In bis decision Judge Criswell cites the fact that tbe law of 1S14 requires the sheriff to deliver to each iuror drawn a seperate ticket. Tbe judge savs UiiB may not seem to be fair compensa tion for the work, but the sherifT assumes all tbe duties of the position when he take tbe office. JrwiB Waluno, in court at Erie on Monday, banded down an opinion in the case wherein a number of Republicans filed exceptions to tbe accounts of Hon. M. Debet in the matter of his nomina tion at the uniform primaries and his election as Mayor at the municipal elec tion held In February last. Tbe testi mony was taken tome months ago and the decisiou of the court has been awaited with considerable interest. The1 decision of theoourtls against Mr. Llebel to the extent that the payments wbicb be made for the publication of the water works articles should have been included In the statement filed with the clerk of courtu; furthermore, that money spent for drinks and cigars was clearly Illegal. The court also decided that the law was not com plied with in buncblnn a lot of names together and saying that tbe persons named were paid f 10 each for acting as poll-workers, for tbe dissemination of literature, for messages aud for acting as deputy sheriffs. The court ssys tbe treating of a jury would be clearly illegal while a case was pending in court and therefore it is not legal or right for a can didate to go around treating voters to ci gars and drinks while an election is pending. Neighborhood Notes. The county commissioners of Warren county are figuring on remodeling the Rouse hospital outbuildings. They may tear down a number of old buildings and erect a large barn. Warren professional nurses have been applied to by Ridgway authorities to go to that place to care for typhoid fever patients. Price seems to be no object and competent persons cau make their own terms. General John Wiley, of Franklin, who bas been in command of the 'id brigade of tbe N. G. P. since 1S87, haa been appoint ed msjor general to succeed Gen. Gobln, resigned. Col. Hulings, ofOil City, bas received the appointment of commander of tbe 2d brigade to sncceed Wiley. The state of M innesota recently tied up a shipment of box car goods from a Chi cago firm. Of eighty-two samples taken from the shipment but two complied with the pure food laws of tbe state and every one of the packages were found a half pound short, which indicates bow these fellows are enabled to underbid the home merchant. McKinley Richmond, a 10-year-old negro, was sentenced by Judge Wilson, of Clarion to an indefinite period In the Morgan Reformatory for shooting and killing his younger sister with Flobert rifle because she struck him with a stone, in May last. The youthful hotni cide pleaded guilty to voluntary man slaughter, and was given a light sentence on account of his youth. On a dare from a companion Harry Ryan, aSmethport glass worker, recent ly climbed to tbe top of the McKean county court house tower aud for a tine sat astride the neck of the goddess of jus tice on top of the tower. He then at tempted the descent, lost his bold, and fell to the lawn below, a distance of one hundred and thirty-five feet. It is need' less to say he lost bis life because be would not take a dare. Henry Lehna of West Newton, Pa. confessed rape fiend, Friday before Judge Thomas at Meadville, under the act of 1907, coufessed to three seperato counts on Alma Whitehead, aged 14 years, and stealing her money. This formal con fession under the act does away with i trial and brings tbe defendant direct to the court for sentence, which will be passed in quarter sessions court this weok. Lehna was told the maximum penalty was fifty -five years. That skunks eat bees is a discovery in natural history that has been made by Harry Rote, of Salina, Cranberry town' ship. He had occasion to visit bis hives on Tuesday and discovered a skunk stationed in front of one of tbe soaps and catching and guzzling the bees as they made their way out of tbe hive to com mence their day of industry. Mr. Rote had a revolver with bim, but wishing to preserve a safe distance botweon himself and the animal did not get close enough to land a bullet from bis weapou iuto tbe body of the bee thief. He returned with his rifle and found the intruder still busy in depleting the swarm, paying no atten tioo to the sting of tbe Insects. Mr. Rote bad much better success with his rille, as the skunk dropped nead at 'the first shot. Derrick. Milton Sopher of Cberrytree township must serve eight years at. bard labor tbe Western penitentiary for criminally assaulting little Fannie Miles, daughter of a Breedtown farmer, on June 20 of tlii year. The sentence was administered by Judge Criswell of Venango county. It I the second longest sentence be ever im posed upon a criminal since bis exper lence as a judge began. Sopher, who 18 years of age and is of almost giant stature, assaulted the little girl in the woods near bis borne. A posse searched for bim two days and he was arrested near Franklin, When arraigned in court at Franklin this week he entered a plea of guilty. Wbeu be came up for sentence Wednesday no member of his family was present, they evidently being satis fled to let him pay the penalty of the law for bis monstrous crime.
