Some years ago the late Dr. Towler wrote an able article on Justices of the Peace, which wm replete with instruction and Interest both in a legal and historical point of view. 'Afterward thinking of associate judges, I noted for several years whatever I could find about their duties and powers, as I knew they were considered by many well informed people, as of little value to the public, but have found this to be a grand mistake finding that they are of more use to the people in vacation, when there is no court than they are during the sittings ot the court. Out of the .57 judicial districts in the state only seven have associate judges any more, Forest couuty belug in lh 37th district. Their duties when there is no court in session, are many, and their powers raultl farious, as will be soeu by the following brief synopsis, under rules of court as fol lows : Kule.fl empowers them on cause shown, in vacation, to enlarge the time for filing affidavits of defense in all acion of assump sit and Scire Facias on mortgages and Judg ments. Rule 9, to approve ball on attach ment cases, and stay of execution on notice and application. By rule 14, Sec. 2 and 3, to grant an allocatur or allowance, requir ing lull in any case, and by Sec. 8, to ap prove of bail which has been substituted or justified and administer oaths. By rule 17, to stay proceedings by special order, on cause shown, on the appeal from the taxa tion of costs, and to shorten or extend the tune for the taking of evidence or deposi tions. In divorce cases to grant leaye to attorneys to issue subpoenas and papers. But the most important of all is under rule 22, on stay of executions, to prevent oppression or correct mistakes or frauds, on application to suspend any writ In the hands of the Sheriff on reasonable notice until the next Coart when the case can be heard by a full bench. Under rule 23, as sociate judges have power ou cause shown to both enlarge the time for pleading or fil ing specifications. Under the Habeas Cor pus act., have full power at chambers to grant relief, remand to jail, reduce exces sive bail or discharge from imprisonment. Also under act of Assembl- to set or fix bail in crimiual cases where justices have no jurisdiction. By act of 1887, P. laws 198, to approve bonds nnder the fraudulent debtors act and grant relief. Again where the body of a citizen is seized by a tax col lector, by virtue of his warrant, for tha non payment of tax, and claims irregularity or oppression, he may apply for relief to an as ssoclate judge in vacation, by staying the collection of the tax upon bis giving bond until the matter can be determined by the Court. An associate judge has power to grant permission to attorney or holder of a judg ment note over 10 years old for leave to is sue on said note upon affidavit before him that the maker is still living and the note unpaid. An associate judge under the Price Act, 18th April, 18"3, relating to private gales of real estate, both in the Orphaus and C. P. Courts, is competent to take af fidavits, grant orders, etc., concerning the same, as are necessary in vacation, Uuder Act 2."), June, 189", P. L , 230, an associate judge can grant rules in vacation to take depositions in other Btates, in the same manner as if taken in this state, and make orders shortening or lengthening the time. By act ft, May 1S!K), can approve railroad and corporation bonds in vacation. By act of 2:ld of March, 1876, can appoint policemen for camp meetings. By act of 17 April, 176, may grant and allow an appeal in all cases of summary convictions before justices. First Pur., 143., an associate judge may appoint two ap praisers in cases of insolvency and perform other duties under assignment for benefit of Creditors Act. An associate judge in va cation can allow appeal from judgment of a justice of the peace for a penalty nnder Pure Food law, or fish law acts or the like. 174 Pa, Reps 2'!. An associate judge can approve all assignees' bonds, under act of 1883, I Pur 144, n. An associate judge has power nnder act of June 29, 1895, to hear and determine cases of persons frequently intoxicated within six mouths and consign them to an inebriate asylum or the Work House for a period not less than three or more than nine months. Under Act 11th of March, 13 i, Sec. 3, an associate judge can approve judgments in default of appear ance aud affidavits of defense, and actions of partition. It is also worthy of mention that an as sociate judje is a "free horse" in the ac knowledgement of deeds, mortages, leases and the like. Under the new replevin act of 1903, P. L 40 and 41, ths duties of an associate are quite important. It provide the Court or judge thereof, at chambers in vacation may allow and grant a longer time than 72 hours in which to file and perfect a counter bond by the defendant, aud 2nd, the judge may ou motion increase the plaintiff's bond, and alter the amount of bail if he considers it insufficient etc. These are only some of the numerous powers of an associate judge in vacation. His duties on the bench are of minor im portance as compared with those in vaca tion, such as advising the President Judge of petitions for roads, election places, liquor licenses, appointment of towusbip officers to till vacaucies and other minor matters, merely advisory. While tho associate judge is not eenerall v learned in the law, in questions of doubt in vacation he can always consult an Amicus Curia, or friend of the Court, who is some lawyer not interested in the case, who freely and cheerfully advises him aud does not dare to give him false counsel. The above is not written at random, but is the result of careful research, as stated, so that the people generally might under stand their servants, the associate judges, ami wd at value tuey are to them. The candidates for the several offices shall have their names announced in one or more of the county papers at least three weeks previous to the Primary Meetings stating the office and subject to the action of the party at the said primary meetings. 2. The voters belonging to the Repub lican party in each townsbipand borough shall meet on a day to be designated by the County Committee at the usual place of holding spring elections, at 2 o'clock p. m., aud proceed to elect one person for Judge aud two persons for Clerks who shall form a Board of Elections to receive votes and determine who are the proper persons to vote and who shall hold the polls oeii until 7 o'olock p. in. After the polls are opened, the candidates an nounced shall be balloted for; the name of each person voting shall be written on a list at the time ot voting, no person be ing allowed to vote more than once for the same office, 8. After the polls are closed the board shall proceed to count the vote that each candidate has received, and make nut the returns accordingly to be certified by the Judge ami attested by the Clerks. 4. The Judge or one of the Clerks ap pointed bv the Judge of the respective election district shall meet at the Court House, in Tionesta, on the Tuesday bil lowing the Primary Meetings at 2 o'clock p. in., having the returns and list ol voters, and the person having the highest number of votes for any office, shall be declared the nominee ol the Republican party. 5. The Return fudges shall be compe tent to reject by a majority the returns from any district whore there is evidence of fraud, either lu the returns or other wise, and shall reject them where there is evidence ol three or more persons vot ing at the Primary Meeting who are not Republicans. (t. Any two or more persons having an equal number of votes for the same office the Judges shall proceed to ballot for a choice, the person having the highest number to be the nominee. 7. The Return Judges shall appoint Conferees Redresentative, Senatorial an J Congressional whose acceptance of said appointment shall be pledge to support the person who may receive the largest number of votes cast for that of fice. 8. The Return Judges may at any time change the mode and manner of selecting candidates as they may be Instructed by the people at their primary meetii gs.due notice being given by the County Com mittee. 9. The Chairman of the County Com mittee shall be required to issue a call in pursuance of the action of the County Committee. Proper Tr eminent fur Pneumonia.
