A case of sottie moment to the tax pay ers of Meyersdalo was tried liefore Judge tlreeron Thursday and Friday. William Forespring, aged 18 years, was riding over one of the bridges in that town on tho loth day of Ieoeinber, IX'1, w hen hi horse broke through a plank and threw him. He claimed lo have sustained per manent injuries to one of bis legs by rea son of the accident and his father entered suit against the borough to recover doctor bills and loss of his son's service. The father wiii awarded J-IihI by the jury w ho tried the ease. Upon the son's arriving at his majority ho brought suit against the borough of Meyersdale for ?o,WU damages for injuries sustained. The plaintiff testi fied that one of his legs had been lerma neutly injured by reason of the accident and his testimony was corroborated by the evidence of bis wife and four or five physicians, who bad examined him. It was also shown that the broken plank was defective when it was put on the Lridge. Expert witnesses for the de fondant testified that they" had lieen unable after a searching examination to discover that the plaintiff had sustained any permanent injury to his leg. After remaining out all night thejury returned a verdict for $VX) in favor of the plaintiff. Messrs V. Hay and Hay A Walker ap peared for the plaintiff and Messrs. Kooser and Koontz for the defendant. The Standard Siatle and Supply Co., limited, were the plaintiffs in an action brought against tbo Eistie Mining and Manufacturing Company to recover 51T.-I.70, with interest for two mining si-ales. For not only did the Com missioners neglect Ui do their sworn duty w lieu they refused to pay these bills, but they went a step farther and trampled tho statutes under foot in giving the Sheriff's election proclamation to one of the papers for a trifle and paying out the public funds for this work without a ves tige of authority tor so doing. Judge Ureer said, when this fa-t was brought out in the testimony, that the Auditors would have to attend lo this and see that the Commissioners refunded the money they had squandered iu this unholy transaction without law or license. Judge Harry White, iu response to a request from the Blairsville f ', has written a leter briefly defining the dif ference between the duties of a High Constable and of an ordinary ward or borough Constable, The matter is made clear, although of course mt altogether complete in the limited space at com mand, and w e make the follow ing ex -trai-ts; " The general Constable or 'ward Con stable,' has the general powers of Con stable or a peace officer. Ho is in some respects under and subject to the control ofthe Court. After his election and be fore he takes upon himself his duties, he must give his security to Imj approved by the Court ; be must make quarterly returns to the Court under oath, and the Court must take notice of this return as it is the equivalent of an oath on charge Isp f. .re a magistrate. He can also make ar rests lor breach ofthe peace and on rea sonable cause for the suspicion of crime. From this general indication ofthe duties and authority of what is ward constable' may lie learned the nature of his offier. "The High Constable is only a local officer. He is strictly only the ministe rial officer of the Burgess and Town Council. He gives his bond to them and they, by ordinance, fix his salary or com pensation. He serves the notices of the Council and executes all their orders and ordinances He gives notice f tho bor ough elections and is especially the exe cutive officer of the Council.
