Since the Icsrislature of Texas has adjourned it is learned that the State Treasury is not only bankrupt, but that a deficit of ?14,ii exists. We sugst to our Demo cratic friends that there is no time like the present for following a god exam ple, by diguing their cyclone pit for next year. The eagerness with which the Dem ocrats have seized upon the silver question as a subject for agitation and discussiou proves, not their interest in the currency question, but their anxie ty to get away from the tariff question and their miserable record. They hope by raising a hub-bub alut free coinage of silver to distract the p eoples atten tion from the i Is they have brought upon the country by their free trade legislation. Jn;K tofT, of the Tinted States Court, has knocked in the head that proposed "white supremacy constitu tion" w hich the Democrats of South Carolina intended to fasten on that Jtate, by diciding that the registration law is unconstitutional. It looks as if the oligarchy that has so long controll--d that Commonwealth was at the end f its tether, and the jcop!e will at last have a say-so in the election of its rul ers. The Democrats in the Temiess leg islature have consuniated the steal of the State by counting out Henry Clay Evans (Republican) who was elected by the jieople, and inaugurating Tur ney, the Jieaten Demcratic candidate. The Republicans, the Populists, and ome ef the honest Democratic inem-K-rsof the I.-gislature refused to at tend the inauguration and went to IxiokOut Mountain and dined with CoL Evans, while the Democratic thieves were jubilating over their stol en spoils. This victory over the will of the people will be short lived, or all signs in the jKditical horizon will be falsified. A (WW.E or agents of the State Dairy Commissioner some time since alled for a meal in a Philadelphia res taurant and carried away with them a sample of the butter used ujoii the table. Those samples were submitted to analysis by a chemist, and pronoun td to be oleo, and a suit was brought in liucks county against the owner of the restaurant. A conviction followed, but Judge Yerkes took occasion in his eharge to the jury to say that in his opinion, in taking samples of butter away with them in the May they did, the agents were liable to prosecution for larceny, and that U was their duty to have informed the proprietor of the restaurant that they took the samples, and to offer him payment for them. This part f the opinion of the judge lias raised quite a "tempest in a tea lot," and led to a discussion among hair-splitting lawyers, who insist that the correctness of the opinion dcjicnds upon the manner in which the butter was served to the patrons of the res taurant. Republicans claim that Dupont was elected on the seventh bal lot, when he received fifteen votes. The question of the right or the govern or to sit as senator is one upon which lawyers differ. Senator tJray, when seen to-night, had but little to say. He holds that no senator was elex-ted and that no fair minded man, Kcpulilienii or Demo crat, would contend otherwise. lie is convinced of ieverner Wat-scn's right to sit as speaker and to vote. On the third ballot the Ad uicks followers, who had voted for Wil liam Dupont, went to PennewelL On the fourth, fifth and sixth ballots th y went to Higjrins, and the ballot stood: II. A. Dupont, 14: Higsins. 5; Ri lgely, !; Tunnell, 1. After the sixth liallot a mo tion by Senator Handy (Addick'a leader) to take a ro-ss until noon was adopted by a rote of fifteen to fourteen. Governor Watson, as speaker of the senate, presided at the noon session of the joint assembly. The first bal lot after assembling was: II. A. Dupont, l,-; Addicks, 4; Ridgcly, tt; Tunnell, 1. In the second ballot Ridgely had 10, the rest unchanged. The rest of the luillots, thirty-three in imtnlH-r, showed no change, the Addicks men declaring Ad dicks or isoIkkIy should le senator.
