The case turned on the juiint as to the extent of the aulhoritv of Mdwards to make a substitution of the two new ones for the original conferees after his with drawal. Ash;-o:n's counsel contended that Mdwards having received authority from the county convention to apiiiit conferees continued to have such, author ity notwithstanding his withdrawal, un til the same had been revoked by the power which had granted it and that the authority granted by the convention was unlimited and unconditional. It was also, intended that if Mdwards' authority t name and substitute c. mlcroes has ended by his withdrawal the authority of bin npiMiiiitccs, Imth original and substitute, tided. This lieing so, in order to give Fulton county a proper representation the con vention of that oounty was the proper tribunal under the rules of the party to se!s-t new conferees and that Crilchlield having lieen nominated by three con ferees from Somerset county and the two original conferees who had lieen se kvted by Mdwards and who, if hi au thority ended, were also without authori ty to at Critchlield's nomination was illegal and void. Ashi-oni's counsel strenuously insisted that Mdwards' power was unrevoked and that he had the power to make the sulisti tutiou for Fulton county its much as the ounty convention itself, he standing as its representative, and, therefore, Ash com's nomination hav ing made by the three conferees from Bedford and the three Fulton conferee authorized to act as such by Mdwards Asheoni was projier ly nominated. Paul, in Cone- uaugh township, went to Somerset, w here he rei-eivwl JT!I in the shape of a Cashier's check, and on Thursday he received the cash for the check at the First National Bank here. He got the money ulmut 1 o'clock, and, according to his story, start ed at once for home. When a mile alsive Jacoby's Hollow, he missed it front his pocket, w here he had placed it. Yester day Mr. King came to town and employ ed 4olii M. Sirayer to institute search for the money, and he at oqi-c went all over the route taken by Mr. Kinjj, fully veri fying ?r. They were recommended to mercy. The defense was that the biys did not take anything from the jxistoflii-e, but from the stores, and that the United States Court had no jurisdiction. The lioys were handed over by the father of Burnett, who, when he heard his sou had been accused, corralled them and told them that if they hail committed the depredations they would have to make them good.
