Holderbaum's Hard ware Store. Not Private Streams. Streams stocked with fiih procured from the State fish corcmisioners are not '"pri vate," and ail streams are public according to a decision of Judge Sterret, of the Supreme Court, unless the fUh are pror-aaUd. The decision is a mist important one to anglers la the first p!a?e the spawn must be kept separate, then the mull fish are put into another screen cell, and so oa until the? are large enough to take care of themselves. Een then they are to be kept ia a larger screen cell if the par:y who raises them wants to own thm. O.i!yso much of that stream is private as is within the screens placed there by the owner. The cass in question was Benscoter vs. Long, Lnzerne coanty. A continuous stream divided the land of these men. Tbe plaintiff at a lot of small trout into the stream, aud when they became Urge enough the J-fea iiot C.-bed them out. Suit was brought, and the plaintiff said it was a privats stream, as the dividing line raa more than half way acrogj the stream. It was shown that the plaintiff did not propairate the fish, but merely put them into the stieam to git along as best they could. No stream is pri vate unless the propagation is carried on as previously stated. A ponl surrounded by the owner's land, without any continons How, can be cailed a private pond. Judge Sterret, in tbe syllabus of the case, says : "If the waters of a pond cover a large surface of land, and a persoa whose lands are covered oniy by a part of the water, places fish therein for the purpose of propa gation, the poa l does not thereby become a private pond, within the meaning of tbe ac. of June 3, 1S7S. Neither is a notice that all persons are hereby notified not to trespass oa these lands or fash in this pond, under penalty of the law, s sufficient notice under the set of June 3, 1373, either to strangers or to nighbors." He continues thus. ' The mere placuig of fish in s pond, without any improvement whatever, for the propagation of fish or a game fish, is insufficient to place the pan J within tbe protection of the act of June 3, 1S75."
