Baylor, aged H years, died yes terlay naming from rheumatism of the heart at the home of his parents Mr. and Mrs. George M. Siy lor in this place. The deceased had been in delicate health for the past year but a fital termination of his dis ease was not anticipated until rheumatism of the heart derelop:-d two or three days prior to his death. A peculiarity of the Pennsylvania tramp act is the authority it gives to any person, an officer Or otherwise, upon view of any offease described in the act, to arrest the of fender and take him before a magistrate. The firm of Scott A Ogle, attorneys at-law, was dissolved by mutual consent, Saturday, when thejunior member of tne firm J. G. Ogle, Esq., entered into a partnership with Wro, H. K'oontz, E-q. Five years ago John R Scott, Eq , admitted Mr. Ogle into a part nership, since which time they have con ducted one of the largest aad most success ful practices at the local bar. Mr. Scott will continue tbe practice alone. Monday morn ing Mr. Scott put a force of mechanics at work remode'ing snd improving his Main Cross street office, and when all of the con templated improvements bave been made h will bave the handsomest law offices in town. Horse and Buggy Recovered. George Anderson, the young man from Jenner township, who thn-e weeks i.o cime to Simpson's livery stable in this p'ace and hired a horse and bugy for the purpo-e of taking a drive, notice of which appeared in last week's Herald, has return ed to bis borne and the horse and bugy bave been returned to their owner by tbe young man's father. Anderson drove the horee to a point near Boiling Springs, in Cumberland county, where be claims to have a brother working. It is said that Lis friends learntd ol bis presence in that place sad wrote to him to return to Jenner aa soon as possib'e. Mr. Sim(son has not yet been paid the hire for the team and fays that nnless the money is forthcoming in day or two be will bave Anderson arrested. A Settlement Reaohed. W. H. Ruppel, Esq., ol Somerset, and Elmund Holsoppt, of Paint Township, spent several days in Johnstown last week iu a conference which bad for its object the settlement of tbe dispute between them over the ownership of or options on coal lands, and it is understood tbat they came to an amicable agreement. It will be remembered that in December, IsitJ, Mr. Ruppel madea bargain with Mr. Hoisopple for the purchase, at $!5 5 per acre, of ti7 acres of coal land in Paint Township, which Hoisopple held in fee, and for acres additional, more or less, on which Hoisopple held options, at $U per acre, the contract being tbat the lands should be transferred within sixty days. Before tbe limit of time expired Ruppel tendered the money and demanded the dieds, but Holjpile refused to comply with the terms of tbe agreement. Then the case was taken to court aod only last week was d-cided in an opinion rendered ty Judge Barker, who awarded the land to Rupoel and refused Hoisopple a new trial. It is said that at tbe conclusion of tbe conference in Johnstown Mr. Hoisopple agreed to deliver deeds for the first lands in the salt (970 seres), snd 7u0 acre addi tional, to the Berwiud While company. The S7) acres, it is figured, will bring about lU.Ouu. and tbe 7Cl acres about $10,500, and the remainder of the lands in dispute will be delivered to James and William Thomas, Russell Uhl, and Eaoch Jsmes, of Johnstown, the latter land not having been included in tbe Ruppel option. Kftinedy, president of the Cumberland Valley Railroad, appeared last week ia court at M.-Coauellshurg ia special tension aad presented a petition from bim as president of the Southern Pennsylvania Railway and Mining Company, a abort line running from Marion to the Cumberland V alley Railroad to Richmond Furnace, to condemn that por tionofthe old South Pena roadbed lying between Tuscarora tunnel, in FraLklin county, and Mt. Dallas', in Bedford couuty. Tue corporation proposes to construct a rairoad between the two points, using the roadbed of the South Pean from Tuscarora tunnel. The same corporation has survey ed and located a branch to intersect the main Hue of the Cumberland Valley at or near Newville. The extension, a distance of fjfiy one miles, will be used by the Pennsyl vania Railroad as sn outlet for the West Virginia coal fields, without hauling their freight over the Broad Top Railroad. Tue court appointed seven viewers, who will commence their duties May 7 to value and assess tbe damages to tbe South Penn for the taaing and the appropriation of the roadbed and improvements. Tbe line will extend from South Fork, Cambria county, to Somerset and Bedford counties, then it wiil take a north westly course into Blair county. Mr. Lingenfelter says the road w.ll likely lap the Pennsylva nia and West Virginia at Cessna, if the latter road is ever built ; and it may be extended to Somerset and make connection with the Baltimore .t Ohio at Hooversville or Bethel. He thinks the iarge'arra of undeveloped aal and timber lands in the counties through which the proposed railroad is to run will make the building of the roads paying in vestment Bal'ord (Jiutle. A Strong: Temperance Object Lesson. 'Squire Pattoa has a bottle of beer ia bis ofbee which was taken from the pocket if an Italian who was killed on toe railroad, at this place, several months ago. He has of fered the bottle of beer to a score or more of person withoat money or sny other consid eration, than simply to take it away, but not one has accepted the ofler, and the 'Squire is likely to keep the bottle for aa indefinite period. Mr. Nicholas Appel. in the TtHb year of his aura Mr. Appel st emed lobe in bis ordinary health and was unusually active for a man of his age. About eleven o'clock in the (ornooo, his daughter, Mrs. Cover, went to his room, thinking be was down stairs, aa usual with bim at tbat time a day. She found bim sitting on the floor, supported by tbe wall, dead. Doctors Good and McKinley, who were at once called in, pronounced bim dead for an hour at least. His wife died about seventeen years ago, since when be Las made bis borne with bi children, al ternating aa fancy directed him. He original ly lived in Jenner township, where his wife died, and was at tbat time a farmer. His children, all of whom survive him, are Mrs. Hiram Boyts, of Davidsville, Mrs. Jesse Walter, of Stoyestown, Mr. P. J. Cover and William Appel, of Meyersdale. He was all bis life sn earnest snd devoted member cf tbe Reformed church. A kindly old man who made friends of all be came in contact with. May be rest in peace. Easy to Manage.
