"I have been called upon In court frequent ly to pass opon the age of a tree in order to decide as to tbe date of a land survey," said Dr. J. T. Rolbrock, of tbe state forestry com mission, to a newspaper reporter. "I can not say that tbe rings of a tree are a certain indication of its age, although tbe common belief is that a tree marks a ring every year. I remember a very important case in New Jersey where a great deal deptnded on determining the exact year of a survey. Our side based its case upon the fact that a section of a tree that had been chipped at the time of the survey showed it bad after ward grown a certain number of rings. To show the fallacy of such an argument I produced a section of auother tree chipped during tbe same survey which, when cut in half, had more rings upon one si lelhan up on the other. I asked why one half should be taken any more than the other to determ ine the aje of the tree. Il bad either only made a half ring or a ring and a half some one year. Trees may make no rings some years while in others they may make two. 1 have known of cases in the tropics where they have made three or four rings annual- iy." Aged Farmer Beaten. About ten days a-, according to the Johnstown Herald, Levi Gordon, of Paint towasnip, made a vicious assault on David Soese, of the same township. The two men were at the time in Mr. Seeses woods, where Gordon was cutting timber. Mr. Se-rie t jld G jrln he was ires- passing, and tried to show hi n tbat be was over the line, Gordon's farm adjoining that of Mr. Seese. Gordon became angry and struck Mr. Seese with his fi.t, aj is alleged, and ended by kicking him in the small of the back and throwing him backward over a spruce log. Mr. Setse, who is 74 years of age, wai unable to defend himself against Gordon's vicious attack and his injuries are serious, and. with tbe resultant shock to his system, may re sult fatally. He was able to make his way home, however, and oa Friday afternoon swore out a warrant before Oj-ii. J. Luther, who is also a doctor. The warrant was placed in the h mds of Constable Jere Shaffer, who arrested G rd n on Saturday and took him before the 'Squire, hen he entered bail for a hearing on Satur day next at 10 o'clock in the forenoon. Siaee th-; beating Mr. Seese has been suf fering greatly. In the mtautime the neighbors are great ly excited over the case, and there is said to be mac'a indignation among them against Gordon m account of his brutal attack on ao old a man. Gordon is only 34 years of Bowman-Esherltes Win. The controversy between the Bowman- E-.htr and Dubs factions of the Evangelical Clu-ch, which is of much local interest on account of the Johnstown Church being in volved in the iue, will be passed upon by the Supreme Court about the middle of this month. H. Murray Graydon, of Harrisburg, Master in thecase of Rev. D. S. Manning et al. vs. Rev. James M. Shoop et al, filed his report yesterday in which he decided in favor of the complainants, who represent the Bowman Esher faction. The Master hells that the Conference held at Indianapolis, Ind., in lS'jt, by tbe Bownian-fcahtntts was the only legitimate Conference, and that the action of this Conference in declaring void the trial and suspension of Bishops Bowman and Esher was within its power as Confer ence, and that its final judgment is binding upon the civil courts, as is also its action in recognizing the Norristown Conference as the only legal Eist Pennsylvania Conference. He also decides that the opposition tonfer- ence, held in Philadelphia by the followers of Bishop Dubs the same year, was illegal. The findings of the Master, if detained by the Court, will put tbe Bowman tsbentea in charge of the Church property aad records. The Duos side is now in control. We learn that Paul H.
