The arbitration to which we referred last wetk as then in progress between K. H. But- terbaugb, representing tbe Berwind-White Coal Company, and Daniel Hoir:nan, Jacob J. Hoffman, William G. Sese, Tobias and Sarah Irfhman.and Isaac HoSfuian, involv ing about s:x hundred acres of cy&l land in Paiut township, was decided in favor of the plaintiff. It is probable that the defendants will not abide by tbe decision of the arbi trators and will apjeal the matter to court. Butterbaugh secured tbe coal lands from the defendants, and promised to deposit tbe money for tbe same in bank to their credit. This he did, but through some mis take the defendants did not bave tbe money passed to their c.-elit. Butterbaugh after ward transferred tbe land to the option of the Berwind-White Coal-Mining Coniany. Town council held a protracted session Saturday evening entirely devoted to argu ment on tbe part of Councilman Werner in favor of advertising for bids for the con struction of a gravity system of water works on plans furnished by an eogineer from Ty rone. Mr. Werner was unable to satisfy the other members of council that tbe plan be advocated was feasable and for that reason be was unable to get his resolution to adver tise voted on by them. It is claimed by par ties, in a position to know, that Kimberly run has not the volume of water to supply the demands of the town, and that the point selected by the engineer for a reservoir is not su'.Bciently elevated to furnish nre pro tection. It seems to us that tbe time has come when members of council should rtc ognize the folly of attempting to overcome impossibilities, and that it is tbeir duty to expend tbe borough li nances ia making per manent improvements to the town, rather tbaa to be paying for unsatisfactory plans for water works. What bas become of the sanitary ordi nance passed by town council a few months aso making it compulsory oa the part of citizens to clean up about their premises? It was boldly asserted at the time the ordi nance was adopted that in case its provisions were not complied with promptly measures would be taken for its enforcement. In p-A council even weut so far as to bave all tills rot, ( il can only bs regarded as rot in its present aspect) printed oa rlaming hand bills, which were freely distributed and posted conspicuously in all parts of the town. At tbe time of the paisage of the ordinance the HtBtLD called the attention of the " bor ough dads" to the filthy condition of tbe borough property and suggested cleanliness should begin at home. Well, tbe ordinance bas remained a deal letter and the borough property continues to be the filthiest about tbe town. Jf it were not for the meas ures taken by poperty owners a Ij lining tbe borough lockup to keep tbe surroundings clean il would be declared a public nuisance by tbe grand jury. Tie committee appointed to select a loca tion for holding tbe Annual Meeting of tbe German Baptist dsuoiuinatrbn of tbe Uni ted States next M.ty convened at Meyersdale Monday. The committee will visit all of tbe towns and cities in western Pennsylva nia bidding for the Hunting before tbey ar rive at a decision Tbe place selected will be deeme 1 tbe best for tbe spiritual and bod ily comforts of the vast cumber of people who wi.l attend the meeting. Meyersdale and Johnstown appear to be the leading competitors and the Johnstown IitMtcrat made a strong pica for Johnstown in the is sue of that journal of Monday, when it an nounce! in flaming headlines : " Hall is Eight Here," and followed it with a column article in wbich it says by way of introduc tion : " According to the testimony of hun dreds of the best people in Johnstown ibe city was never so deeply steeped in rice as it is to day." A fine field for missionary labor, no doubt, but if tbe DrmucraC s statements ra correct then we predict that Johnstown will be giv en tbe go-by by the committee cnarged with the selection of a site. Jaw Bone Broken In Thre Placws. Too ranch booie caused William Barren, a young lumberman employed as a car loader at tbe R. R. Elation ia this place, by Eaton Bros., whose mill is ia Lincoln town ship, to fall off a wagon and suffer a triple fracture of tbe lower aw and a scalp wound four or rive inches long Saturday evening. A bout four o'clock in the afternoon Barron climbed onto the rear carriage of one of tbe heavy six-horse wsgons used for hauling lumber from tbe mill to the railroad station in this place. The driver of tbe wagon oc cupied a seat by Barron's side and they kept np a rambling conversation until they ar rived at a point near the Casebeer school bouse, on tbe Johnstown A Somerset pike, when tbe wagon gavea sudden jar, and Bar ron tumbled from bis perch. Tbe driver call ed to bis team to halt and at the same time grasped tbe brake and applied it with all bis strength. The prompt action of the driver undoubtedly saved Barron's life. As it was bis bead came in contact wilti one of tbe wheels that Lad ceased to revolve under pressure of the brake and bis body was pushed on ahead of it until the horses and mules composing the team finally came to a stand-still. Barron presented an awful sight wben be was released from tbe wheel. His bead was crushed and bleeding and be was unable to speak. In a short time the driver of a second luiubt-r team drove up and assisted Barron's companion to carry Lira to the house of Emanuel Bowman, a short distance from tbe s-ieue of the acci dent. Dr. I)iither was summoned to dres the injured man's wounds and be found them as Mated alve. Barron's condition is regarded as critical as there is a possibility that his many wounds may cause bis throat to swell shut and result in his death. The injured man is about twenty five years of age and bails from near Statilstown, West moreland county. It is the duty of school directors to select the best available material for teachers and wben tbey fall short of this tbey commit a moral crime against the children placed under their care. One of the most expe rienced and conceded best and best qualified ttachersin Somerset county was an appli cant for tbe assistant principalship of the Somerset borough public schools. Two members of the board of directors favored bis selection and voluuteered to contribute from tbeir own purses in order to makw np the salary demanded. It is needless to add that be failed of election. Good and expe rienced teachers are not wanted for the ad vanced grades. How long will tbe suffering people of this community put up with this sort of thing oa the part of their public ser vants? It is the iuiertsts of tbeir children that are being neglected and against whom ibe crime Las been committed. Two Laws That Ought to Prove of Inestimable Blessing. The two new law? enacted by tbe State Lpgis!a'ure ia tbe interest of chiidrea and for the prevention of crime will be produc tive of most excellent results. Both bills were drawn up by Thomas Robins, Solicit or, and Richard S. Hunter, one of tbe Board of Managers of the Children's Aid Society of Pennsylvania. Tbe first prohibits the de tention of children in the same an, cell or dock with older prisoners, and provides for the trial of accused children separately and apart from tbat of ado ltd. It is as follows : Sbctios 1. Be il emu!ed b-i th', finale aiul 11 hi of U'irwU Unft of the Conmmvriilti uf l'em;lva!iii t Oeuernl AuraiUg met and it is heref'g tivicted fc.v the anthority of Hie nivK, That no child under restraint or con viction under sixteen years of age shall te placed in any apartment or cell of any prit on or place of confinement or in any court room during tbe trial of adults or in any ve hicle of transportation in company with adults charged with or convicted of crime. Sic. 2. All cases involving tbe commit ment or trial of children for any crime or misdemeanor before any magistrate or jus tice of the peace or in any court may be beard and determined by such court at suit able times to be designated therefor by it separate and apart from the trial of olhtr criminal cases of which session a separate docket and record shall be kept. No one who is familiar with the scenes of a criminal court trial and has witnessed the absorbing interest with which juvenile of fenders drink ia every word and detail in the history of a crims can doubt that this new law is a step in advance. Tbe other bill was modeled after Ibe act which authority tbe commitment of chil dren by Magistrates and Judges to the House of Rifuge, with the very distinct dif ference that charitable and incorporated so cieties having certain objecto and methods are substituted for the House of Refuge. This act waa framed to meet the needs of a c'ass of cases brought daily to the notice of Judges and Magistrates, wherein very young children, untni.'-akably suffering from ne glect and often ill usage, are brought before the bar of justice as lawbreakers. Mot judges and many magistrates are perplexed and distressed at the alternative which bas hitherto obliged them to commit such ex tremely young chiidrea to a reformatory, where tbey are undoubtedly out of place and at tbe mercy of older inmates, or to re turn them to the misrule and neglect of their wretched parents. Even withont legal sanction in its strict est sense many Judges began to avail them selves of the Society's willingness to receive children experimentally, and since l1!) have turned over many young offenders to lhe Children's Aid Society without formal com mitment. The new law now gives tbe ChUdren's Aid Society a legal standing in Court and legal control over the childrtn committed to its care. While in no sense a reformatory institution, the society bas a very jmportanl mission to perioral in tbe field of preventive work and in stadyine tbe causes and cure of crime. It receives chil dren from police stations and court rooms, with tbe understanding tbat such children are more in need; of cart than of punish ment, and t great cost and by dint of extra ordinary e'jort it labors to bestow on each child the gifts of life hitherto denied it. good borne, pure surroundings food, cloth ing and personal care.
