He spoke feelingly of the retiring Judge, Baer, to whom he paid glowing tribute, and in tbe niost compli mentary terms of the incoming Judge, Long- euecker, for whom be predicted a cireer equally as brilliant and successful as bad been that of his predecessor on the bench. His introduction of the several speakers of tbe evening was always accompanied with a few happy remarks on the speaker or his subject. JUDGE HACB was introduced to iwponu to tne judi ciary, of Somerset county. He said t "We arc not assembled to speak sad thoughts. This U not altogether a frtst of reason, for on.Joubtedly some of you have eaten unreas onably." He then spoke in tilting terms ol the number of illustrious wen who bad pre sided over the court of this district ; named the various Associate Judges who had occu pied the bench in this and Bedford county. sayir.g a good word for each, and expressed bis gratification at being succeeded by so worthy s gentleman as Judue Lontrenecker. He was greeted with prolonged ap plause which was renewed at the close of bis remarks. He said, in part : I desire, before saying another word, to thank you. gentlemen ot the (Somerset liar, most cordially and sincerely tor my part iu this sumptuous entertainment and graceful expression of your good will. The theme suggested by lb toast to whicn I have beeu requested lo respond is full of interest to our proieseion, and if I were to adhere to it, I would probably speak of Jav, Marsbad, sto ry and some of tneir illustrious successors on tbe .supreme tsencn of met. a., or oi tiinny, (noson and others of our own Su preme Court, as well as the many eminent jurists of our Common Pleas Beucn. But ;w.f praiirtiitf gpeake s are not exiecteo to auuere vci jr .ioseiy wiucn sou ,ov j theme as tluei.t as tbe sea," I prefer to-night to (routine my rejnarks to matters nearer home. 1 wish to p. ace wreath upon the brow if my distinguished predecessor, wnose modesty forbaJe Mm to speak of bis own lerm ot otlice. His record as jurist is one of whicu be and his triends may well feci proud, aud I but leeoty express tbe senti ment ot tbe Bedford Bar wuen 1 say that thev entertain for him nothing but the high est regard and must sincere Ir.endship. ilia enviable record is now a matter of history, and may be live long to erjoy his well earn ed fame. If 1 couid hope lor'a career like it. I should be most happy. I bad many pleasant impressions oi som erset county belore I ever set loot in it. At the beginning ol the war I met in training camp nearly a lull regiment of the rljwerof your beat young niaiinooa, tne ouu anu promise of your county; jo.n; men, wbo wben the roar ol tne tiral guns slid ecnoru mong tbe bibs of irginia, took tneir lives in their bauds aud ottered them lo their country, turned tneir backs upon their Homes and all the sweet lies that tuade these bills so dear to them, and dared lo go down there and loos into the muzzles of the long lines of leveled guns: young men ali aglow tn uatrtotism and torcetial ol sell, eome of them returned with the thinned ranks :id Uttered banners of that regiment, but many sleep in distant gravrs made aacred by tueir blood. You bave en-cted a monument in the court hoa-e yard to tbe memory of those son of your county wbo (ell in thai awful strtggie, and loving hands nave in scribed all ol their names upon it. A list more worthy than tuat of louidas and his Mpartaus. it is as creditable lo you as lo tuetu. But tbe Judiciarv W ould yon expect Common Pleas Judge, at the Close ot nia first day on the tiencn, to bave sufficiently recovered bis bead to speak on that subject, wnen one s mind is still engrossed witn tne stirring events of tbe dav .' In my practice of twenty odd years I at across lhe table from a partner wbo was a most anient au mirer of your own Judge Black, and he nev or lire.) in hiseniueies un tbe overshadow ing ability of that d'snnguisbed jurist ana lswver. I can only say that I will give to the responsible duties before me my very best efforts, and in tnai important work 1 bespeak your friendly co opera' ion, and I feel that I shall have it Let me asrain thank you for this generous and kindly evidence of your friendly feel ing." JCDOI SASEIk. Hon. A V. Barker, President Judge of tbe courts of Cambria county paid his respects - To the supreme court of Pennsylvania." "It ia a matter of congratulation " be said, that from ths lawyers of the Somerset bar had been selected one for tbe highest position known to jurisprudence in tbe State, tbe Chief Justice of ibe bapreme Court of Penn sylvania. He pa;1 h'8 tribut t tbe memory ot tbe late Judge Clark oith-Supreme Court, and in tue short time a. letted entertained bis bearers in a most chaiming manner. He was roundly applaud I at the close of his remarks. Without tbe snhts-rt disparagement to ttose who preceu ' A a o .-. - a . ed or followed Lim, Judge Barker's was unaniinouily voted f.Vc speech of the evening. "0CB COMMOU WIALTH," was to bave been responded to by Cyrus E'der, F-si , of Johnstown, but the following telegram received at a Lite hour explained ttiat gentleman's nnavoidable absence. Is-lavc-i tr ctud and grippe symptoms. much to my resret CYBCS r' ttrn. r. i. ocossos, esq., Cambria county's handsome District Attor ney, was called upon by ths Toast-master to respond. Mr. O'Connor regretted deeply the sickness which had deprived bis fellow prac titioner, Mr. Cyrus Elder, from participating in tbe delights of the evening, and then spoke briefly on the aubject of ths toast. He was followed by a. c. HOLBcrr asvj , wbo said : ' If the subject were 'The Commonwealth' it would strike all of as as tbe papers in dorsed 'Commonwealth vs. Smith in wbicb we are all highly interested. Those are mournful documents, but at tbe same time there is a humorous phase connected with them. For instance, on one occasion I visit ed the jail to see a client of mine wbo had been committed and shortly was to be sen tenced tu tb penitentiary : a leliow in an adjoining cell said, "wbo is there?" My cli ent replied, u is my attorney, Holoert " "Please tell him to come tbis way." 1 asked what he wanted and he replied, "will ibe judge ask us whether we have anything to say ra lorene pronounces sentence upon os r I told him, "always." "Well I am think ing." said he, "of telling him to consider the kind of lawyer I bad and that he should let me on as light as possible. But it is not likely that the loast refers to tbis kind of commonwealth. It may refer to the cou n try at large or to our own State, the most glonos commonwealth in tbe I nion, whose bills are veined with ores of ail kinds, whose streams Cow with oil. whose valleys are filled with coal, and whose surface produces grain in quantities sumcient to ward off famine from half tbe empires of tbe old world " With a few more eulogistic re marks in honor of Pennsylvania Mr. Hoibert took his seat amid great applause. "ths maul LAWTra." Paul A. Gaither, Ksq , of Greensborg. Pa., responded to tbe toast, "The ideal Lawyer." Mr. Gaither said be always remembered with pleasure the fact that be bad com menced his professional life as a member of the Somerset County Bar it being one tbat bad produced a number of ideal lawyers. Judge Black, Judge Rimmel and Judge Baer. were all lawyers of tbe hrst rank. Black at taining a National reputation. He aaid tbe law is a jealous mistress, and to succeed in the profession requires continuous and hard labor. Perseverance, industry and integrity should be the motto of every man wbo aims to be a successful lawyer. Mr. Gaither inieri?rsd bis graver talk with some rich anecdotes and reminiscences and sat down amid appiauie. "THE rBOOEFSS of thx i.tw." " The progress uf tbe bight," said Mr. Kooser, who was invited to respond to the above toast, " could be commented on much more effectively than the rrogresj of the Law' at that hour, aud that it was on I v to delay, and thereby render tbe more delight ful that wbicn an ears were set tux. " Tbe Law and Ibe Lady." that be waa wuhng to take any time at ali. Everyone knows that tbe law has kept step iu the procession with civilization's general march, and tbat from a condition of vaasatage men weie genuine freemen now ; and yet more wonderful, tbe law has made such great strides tbat it act ually permits a woman to bave proprietor shipof her property. What is hers, is real ly her s. I he lor is at one time could say, 'what is mine, is mine; and what is yours, is mine.' Now, they can't. Whether they bave thereby ceased to ba lords, is another aiatu-T. But tbe subject is too large for tbis hour. Tbe law has made some remarkable progress ha:tnrtl tbat may be noticed. In tbe mat ter of pleading, tbe Pennsylvania Legisla ture has succeeded at one mow in sinking down our common law system of pleading. that bad taken generations ot the ablest and most scholarly lawyers of England and America to bring to tbe perfection it bad at tained wben tbat august bodv at Harnsbure aboli.hed it. In las niatterofevidence.it may a e l be questioned it it is not progressing backward, tbat has broken down the barriers aud radically permitted every one to go oa tbe witness stand, without regard to bis in terest in the case. Such lerisWion has giv en us a generous supply of testimony, often of a dubious quality. Fiat contradiction in trials occur now so commonly that they cease to ortend Ibe public ear. It is not many yean ago wben a contradiction such as these gave a profound shock to the enttre audience gathered in the court room. There may be benefit in Ibe particular case beinu tried tbat all parties should give their story, but tho injury, if it be conixk-d there beany, is to the whole public in becoming enured to strained or false statements, born of interest in the cau.,s "LIGISlUTlOJt." Hon. A.J. Colborn was expected to talk on "Legislation," but, much to the regret of all his legal brethren, was detained at home by a bad case of tbe prevailing epidemic, grippe. "Legislation" was on tbe bills, bow- ever, and had to be piTformed, so tbe Toast- master called upon I'isttict Attorney, L. C. Colborn, for response. Mr. Colborn remark ed that be thought tbis was a case of "visit ing tbe iniquities of father's upon tbeir chil dren" and then proceeded to handle the sub ject of legislation in a manner that would bave done bis sire proud. "THE LAW ASD THE LAPT." The last speakerof the evening was J. L. Pugh tbe Toast master having reversed tbe order, as be said, tbat the best might lie kept until the last. In the introduction Gen'l Koootx referred in fitting terms to Mr. Pugb's ability to speak both of tbe Ijiwsnd tbe Lady, and re fen red to the fact that he was one of our own Somerset county boys from Sheep-ridge. Tbe speaker arose aoiid rounds of applause and when quiet was re stored he niouesily remarked tuat the Lady bad long retired aud the Lawyer should bave done so but the fa;! that the speiker in introducing him referred lo the fact that oe was f'om Sneep-ridjre reminded him ol tbat fact and be must tax the patiencs of bis bearers and a-It pardon for lhe digress ion while be informed them that such was the case and be menly w )d toreniatk that it was tailed Sheep-ridge btsause the prin ciple production was sheep, that the cou a try was so poor that ibe noses of the sheep bad to be ground to a point in order that tbey might get at tbe blades of grass grow ing between tbe rock. The hogs were so lr that tbey bad to be held up to squeal. The dofcg bad lo lean against tbe fence to bark at a stranger, and it took three bead of cattle to make a shadow as lhe sun wouid shine through one or two. Tbe principal product of tbat country was horse-radish. Charles Bead, said the speak er, bad written a bock on tbe subject of tbe " law and the Lady, ' and if be wished to exhaust the subject, the members of tbe bar would require breakfast belore returning borne. But be would.be brief. Our life was two-fold, and when tbe forces came in con tact with each other we have what in law is called an issue. The Law is as supreme ly grand and autier as woman is lovely and beautiful. Uur Master, I'.iacknoiie. truly says, "the law ia a jealous science," and tbis may acconnt for the fact that I have no lady, for I would have you understand I am a bachelor and will have no one to grumble al my cornir.j home so early in the morn ing, as many of you will have on this occa sion. In that respect I am in accord with tbe ancient Turkish maxim "to be a bachelor is to be a King." Tbe Law and the Lady. I know very little of ftie brat and lees of tbe second for she is full of mystery snd her wars are past finding out. and yet, I should not object to forming a life partnership with the riitbt kind. I need eqiiitable relief io that direction and I pray the Court to r"ant it t tne, (It was granted by His Honor Judge Iaicgenecker immediately t for io spite of ail the dilatory pleas that I have en tered my case i becoming a serions one. 'THE BAB or SO MIES IT COISTV." This toast wss responded to by Mr. Ends ley, wbo, after some allusions to the ti tle "Toast master." In which be maintained that the head of tbe festive board should bave some short and appropriate name to desig nate him, said, in part, he feared the com mittee had made a mistake in assigning to him the duty of responding to that toast. That the Nestor of tbe bar should have been called upon to replv lo a subject so tor reach ing, demanding as it does an intimate and long continued knowledge of tbe members of tbe bar: tbat however pleasant a task it might be to take up and lovingly dwell anon those names in which all took oride. time would not permit it.
