The prisoner was brought Into Court by the
Sheriff,
General J. X. -PurvLarice, on part of the de
fence, and with the concurrence of Isle col
leagues, moved that the witnesses on the
part of the Commonwealth, as well as those
on the part of the defence, should retire
from the Court Clouse, and be kept toe room
by themselves until called upon to testify.
The Court obi,erved that the witnesAes
could not bear of what wav testi
fied by wltneAses. from their position in the
audience. Unless the Court bad evidembe
that there was a combination, they would
not make an order for that otirpOse.
Mr. McCarthy and Mr. MtCatutlesa urged
that it was discretionary with! Ulu Court
and they appealed to that discretion.

doctor the nature and character of the
wound of Teeple, now proposed to ask Ulla
witness (who was present at the exemitia
tion—the body of Cunningham lying in the
room) what took place at that examine.

the character of the wound of Teeple was uo

Teeple; hence this evidence was Irrelevant,
and had nothing to do with the cane.
