LIC1115111C•11. Au information
eras yesterday lodged spinet George Finley, of
Wilkins township, charging Dim with violating
the ordinance in relation to the license of
vehicles in the city of Pittsburgh. The defend.
ant Is the owner of a roar horse team, on which
his sands hauled to the glass factory of ACKeo
& Co , in Birmingham. The wagon palms
through the city, and it was claimed by the So
licitor, Mr. Riddle, that, by the recent act of
Assembly, the owner was obliged to procure a
license. He claimed that Pittsburgh was de
fendant's principal place of business, and, as
he had no office in any of the boroughs author
ised lo grant licenses, he ought to obtain one in
the city.
Mr. Carnahan for the defence, insisted that
demerit passing through the city of Pittsburgh
on his way with a load of sand to Birmingham,
did not make the
.defendant liable under the
license law. If the inquiry were made whore be
did the most of his business, it would probably
be ascertained that be did it in Birmingham, as
his orders came from that quarter. The ques
tion will be removed a higher tribunal, no
Matter how it is decided below, so that any nice
points Involved injit will be settled. The city
has certainly an equity in the premises, if not a
legal right, se the defendant penes through its
whole length every trip he makes and probably
pentributes as mach to render paving and repairs
?unwary as most persons who pay license. ins
matter was held over by the Mayor for reflec
tion. We shall endeavor to Apprise our readers
of his decision when it le announced.
