The defend. ant Is the owner of a roar horse team, on which his sands hauled to the glass factory of ACKeo & Co , in Birmingham. The wagon palms through the city, and it was claimed by the So licitor, Mr. Riddle, that, by the recent act of Assembly, the owner was obliged to procure a license. He claimed that Pittsburgh was de fendant's principal place of business, and, as he had no office in any of the boroughs author ised lo grant licenses, he ought to obtain one in the city. Mr. Carnahan for the defence, insisted that demerit passing through the city of Pittsburgh on his way with a load of sand to Birmingham, did not make the .defendant liable under the license law. If the inquiry were made whore be did the most of his business, it would probably be ascertained that be did it in Birmingham, as his orders came from that quarter.
