This case 'hats ivan• dered through the courts like an nneasi\gbast, and at hat, under a decision in the District Court, as we understand it, Mr. Risher put: his Goal road from his pit mouth to tbo tipple on the riser. The dispute between - the parties origi nated in contending claims to the right of way over this property. Mr. Hays' road had been built for some years, when Mr. Risher built a road under it. The latter road came down , :the bill near six mile ferry, in Baldwin township, for some distance, nearly parallel with the iced of Mr. Hoye. and then with a curve crossed ,pa der the road first, built. On the third of latit November, Mr. Risher cut down the road which Mr. Hays had built at a height of six feet share Mr. Risher's. The road was repaired, and, on the ith of November was again out down. Oct of these collisions between the parties arose threats and prospects of personal danger. Mr. Risher lined out o surety of the peace againtit Hays, and aye against Risher. It was alleged in the case of Risher vs. Hays, that the former, on the oce ion of the cutting down of the read way, had ado violent threats and medicine at mon on t e works , with -.an ax.
