Barker was indicted for nuisance in obstructing the streets by speaking from a stand near the depot on Sunday; by col lecting a large crowd in the public street; by using loud and indecent language such as to shock Ladies and gentlemen passing on the street. Mr. Collier opened the ones for the prosecution; T. M. Marshall, Esq , was associated with Mr. Collier in the prosecution, while Mr. J. T. Coch rane appeared for the defence. 3. K Morango was the first witness sworn— A..m a banker of this city; know Joseph Barker; on Sunday, in March, saw Barker speaking on a pile of lumber at the junction of Liberty and Grant streets; there were about from five to eight hundred persons listening to hue; found no difficulty to inkling; it was from one to three o'clock; at that hour there were ladies passing to and fro; could not state the particular lan guage used; he spoke on various subjects, on the Mayor's police, the Mayor, the administration of the laws, the churches and the county bonds; just as he reached this point, he was arrested; he spoke of the Mayor'. officers as in °allusion with thieves, and that the Mayor's portrait ought to be hung up in every brothel in the city; he eaid the preachers were nll a,eet of thieves; his language was not decent; it was too indecent for the public ear. After a lengthy cross.examination of Mr. lorange, and nothing of importance to the de fence having been elicited, Messrs. Robinson, of the True Press, and O'Neill, of the Chronicle, were put upon the stand The latter, who was present on the occasion of the speech of Barker, on Sunday, the 13th March, detailed as he was asked and reunited to do, certain portions of tho speech which he had laid up in mind. He stood near the rostrum from which Barker spoke, and a portion of the remarks of that personage were directed towards him They were and are too obscene not only to be printed, but even to he thought of. ' The case exci:ed altogether more attention than its importance deserves, owing, however, to the fact that these tirades of Barker have boon long continued and were the cause indirectly of bringing him once before into a position of trust and power. Other witnesses for the prosecution—Messrs •G. W. Clark, Hugh Magee, W M. Hartzell, C. Kelley, John Brishin, Robert Hague and W. C. Wray—were examined, the general tenor ef the testimony bong Hutt the language of Barker was obscene and indecent, and that the crowd he collected obstructed the street . Toe defertee coiled Messrs. These of these witnesses who were able to hear what Barker did say, thought his language was Somewhat indecent, and that though the crowd I did not much obstruct, they, nevertheless, stood upon the side-walk. Biddle Roberts, then said he wan ready to enter upon the trial of the cave of the United States against Silas J. Cover, indicted at the last term for embezzling money from the mails at Davidseille, Somerset county. in July. 1850 The cane was pat on trial, Cover was brought into Court, and for the defence nppeared 01 Swart:welder, Esq., of Pittsburgh, and Messrs. Coffroth and lingua, of Somerset. The indictment charges defendant, who wan Aseietant P. hi at the time, with open ing a letter and taking therefrom the sum of $OO in bank-tills. The penalty fur the offense is not lees than ten nor more than twenty-one years imprisonment in the penitentiary. The acts of Congress bearing upon the alleged offense having been read by the District Attorney, wit nesses were called for the prosecution. The first witness called was Peter Levy, who testified to having deposited certain notes, marked so as to be recognized, in the post office where Cover was master. The notes were here offered in evidence. D. W. Moork, special mail agent, was called, who testified to having followed,up lilr Cover; went to Philadelphia, where Cover was at the time, Sept. 13, and traced him to the Union llo tel. The first afternoon, in his search, he was not able to find any of the notes which it was supposed WiII:MPS had taken; ho could not learn he had paid out anything but cold; following day, at the boomer Tuitt & Bro., got a $2O bill, bank of Old Dominion, (note shown and identi fied,) and paid them in gold for it and took it; the note I gave to the District Attorney, Mr Roberts. The next wetness oalled was Charles Boggs, clerk of Tuitt & Co., where Mr. Moore obtained the $2O bill, to to the means by which Boggs came into possession of it. Samuel M . Niullin, receiving clerk of the City Bank, Philadelphia. testified as, to hie having obtained the money in the course of a deposit from Tutu & Co., and its not having been bank able funds that it yea returned, thus tracing it beet to where it was obtained by Moore.. Mr. A. 11. Tippon, who arrested Cover, was examined. Testified that Cover said, when ar rested, that he remembered about the letter in question, but "knew nothing about it." Judge Marsh decided that the prisoner was illegally held, and discharged him. Immediately after bin dis charge he was re-arrested, hand-cuffed, pot in a hack and driven to the depot for the purpose of taking him to Wheeling, on the train then due at the depot. A desperate effort was made by negroes to rescue him, but was nnsuccessful. During the excitement at the depot, pistols, clubs and bricks were freely used, and several persons were injured. In the mean time a writ was served on Marshall commanding him to bring the prisoner back, and show why he was hold. This point has nut yet been settled.
