They were new, and had not, ap parently, been used at all Mr. Howard, for the defendant, raised the question of law that it had not been shown that there was such a bank as the York County Dank by the prosecution; that the prosecution had also failed to show anything going to prove that the man lived in Allegheny county, or that ho had forged the note here or elsewhere. Mr. Collier said they bad drawn the beet in dictment they could with the facts iu their pos session, and that ho knew before the case came on that they couldn't make a clear case of for gery against the defendant. He was willing to let the matter go to the jury on the charged( the court. A verdict of not guilty was rendered. David Dunsenth, charged with (moult and battery on oath of John Adams, of Draddock's Fields. Mr. Adams being put on the stand tes tified that he left some spoons in Dunseath's, with orders for some more to be made like them. When he went bock for them some hard words passed between him and Donseath, when the latter ordered Adams out of the store, and be not going very readily, D. laid hands on him to pot him out. Lewis J. Fleming was sworn and testified that he was present, and - that Mr. Adams said ho would go if Duneeath would give him his spoon.
