Mr. 'Wallace, who le a commission merchant doing a large business, was indicted under the act of 1858 for selling liquor without a license. Mr. Wallace, in the regular course of his busi ness, receives large oonsigumenta of whisky from Ohio, which pass through his bands, and on which he receives his commissions; he never sells in less guanines than a barrel, and be had .only taken out the regular mercantile license, as he supposed that was all that was necessary to entitle him tocarry on Me business and com ply with the demands of the law. The District Attorney was not so clear in his opinion, and to test the gutllon and settle it, brought it before the Court above. On• Katurday last, Judge McClure rhadered his opinion In the case. He believed that the, indictment under the law of 1858 would not hold, and it was therefore quash ed, but under other enactments and parts of en setmenta chick he cited at great length be thought an action would lie. His mer cantile license should set forth the fact that he i had paid ell My per cent. in addition to what ho had paid f t r license to sell other goods, aside from lige° Mr. Wallace is a vender of liquors, of that there is no doubt, and, whether sold on his own or Ithe account of others, should pay eighty per cent. above tho ordinary mercantile lax. The j•dge thought the additional commis sion whichpur merchants would fi nd itneoes eary to charge the Ohio shipper in order to cover the extra license would not at all affect the course of trade in this article. Ile said that probably 20 casks of corn whiskey from Ohio came hero to one that was made here and shipped away ; that n fact this common stuff at 20 cents per palestCu crowding out of the market all the honest Z-3 , e whiskey that was made in the old substantial way. Ile believed that the ens pension:of this license was taking from our State Treasury a largo sum of money that ought to go in there, and was unjust to our citizens; that a large amount of revenue might be derived from this source .annually, and if the existing laws were not suMoient for its collectimi, other Ingle lation should be had on the aubject. The indict ment against Mr. Wallace was quashed, but, at the same time, the principal wee pretty well established that commission merchants who do not-pay double the usual mercantile license, lees twenty per cent., are liable to indictment. Os the 28th December we published an ex train from some Steubeville paper, a statement to the effect that a Mr. Jacob S. Showman had taken a negro boy from Steubenville, named Ceo. MoPhearson, and sold him into slavery in Arkansas. Mr. S. was very much troubled about this story and started at once to set it right. He is a Pennsylvanian, known to many hereabout. Ile called upon us on Saturday and most emphatically contradicts the whole matter. lie says that be did engage the lad in Cincinnati, took him with him as he did other laborers, and that the lad is now at his home in Ohio.
