A disposition has been made manifest, with in the lost few years, by some of the officials of the Federal Government, exercising their functions within the limits of Ohio, to disregard the authority, and to encroach upon the rights of the State, to-no-extent and in a manner | which demands your noticed I In February, ISoO, several colored persons ! were seized in Hamilton county as fugitive j slaves. One of these persons, Margaret Garner, : in (ho frenzy of the moment, impelled as it seems, by the dread of seeing her ohildren drag ged. with herself, back to slavery, attempted to ■Uy them on the spoW-OfiAoctually fluocoeded in killing one. iv. •.!..• u.r °ow paniens, were Indicted by the grand jury for the crime of murder, ana were taken into cus tody upon a writ regularly issued from the I'ourt of Common Pleas, While thus imprisoned upon the legal process of a State Courtjfor the highest crime known to oar code, a writ of habeas corpus was issued by the Judge of the District Court of the Coiled States, requiring their production before him. The writ was obeyed by the Sheriff, and contra ry to all expectations, and in disregard, as I must think, of principal and authority, the prisoners were taken from fcfs custody by order of the Judge, and, withoG?allowiog any oppor tunity for the interpositou of th 6 Btateauthori ties, delivered over to the Marshal of the United States, by whom they were immediately trans ferred beyond our limits. The alleged ground for this action and order was that the indicted partial had been seized os fugitive' slaves upon a Federal Commissioner’s warrant, before the indictment and arrest, and -that the right to their custody, thus acquired, Was superior to that of the Sheriff, under the process of the State. This doctrine must oeccs? aarily give practical impunity to murder when .ever the murderer may be seized by a Federal official as a fugitive from eervica before arrest for the crime under State authority. Imputing no wrong intention to the Judge, l am constrain ed to add Hist bis proceeding seems to me an abuse, rather than an exercise, of jadicfal power. Several deputies of Ibe I Federal Marshal, having amatod certain citi zens of this Slate for some alleged offence I against the Fugitive Slave act, a writ of Habeas | Corpus was Issued by the Probate Judge or that 1 county, requiring the arrested parties to be brought before him for inqairy into the grounds of detention. Tbe Sheriff of Clark county, while attempting to execute this writ, was assaulted by these petty officials and seriously injured, while his deputy-was fired upon, though happily with out effect. A warrant was issued by a Justice of the Peace for the apprehension of the perpe trators of these offences. This warrant was duly executed and the prisoners committed to jail under the custody of tbe Bheriff of Clark county. A writ of habeas corpus was then Issued by the same District Judge who had Interposed in the case of Margaret Gahier, requiring the to producchls prisoners Charged with tha eieeatiou of a VTTrfral writ, to overcome, by on, necessary jiolenco'all attempts made under (he process of ggtSe court, to detain (hem or their prisoners, even for inquiry into the legality of (he custody in which those prisoners wete held. , . It asserts the right of any Dietrict Judge of the , United States to arrest the execution of Stale process, and to nullify the functions of Slate courts and juries, whenever In his opinion a per son charged with crime under State authority, ; has acted in the matter forming the basiß of the Charge, in pursuance of any federal law or war | rani. No Act of Congress, in my Judgment sanc tions this principle. Such an Act, indeed would ihe clearly unconstitutional, because in plain violation of the express provision which re quires that Ihe (rial of oil crimes shall bo by 1 {7is deeply to be regretted that collisions of this klpa should occur. The authorities of Ohio have never foiled in dno consideration for the constitutional rights of Federal Courts, nor will they thus fail. But they cannot admit, without dishonor, that Bute ptoceaa it entitled to less respect than Federal, nor can they ever concede to Federal wrils or Federal offioials, a deference which is not conceded to those of the Stale. The true course is one of motual respect and mutual deference. Whenever, in any inquiry upen habeas corpus, by any Court, State or Federal, it maybe ascertained that the applicant for the writ is detained under valid process in pursuance of a constitutional law, he should be remanded at once to the custody from which he may haTe been token, for trial in due course. No investigation should take place into the gttiU or innocence of the party charged, or what !is substantially the same thing, whether the facts were justified by the authority anew which the applicant was acting at the time. In quiries of this character are for juries upon a regular trial and in open court; not for a judge at chambers. If made open one side upon habeas corpus, they may also be made upon the Other. If Federal court* are to protect Federal official! from proseoutlon by Btate courts, for violation of State law, StAte courts, in their turn, must protect State officers from prosecu lion in Federal courts under similar circum stances. If the power and patronage of the Federal Government can secure the ad mission or Kansas Into the Union under this slave-state Constitution, that power and patron age will, without doubt, be actively employedto that end. In alt this the people of Ohio have a deep and vital interest. It is beyond question that a vast majority of her electors are opposed to that interposition of the Federal Government in behalf of Slavery. 1 trust that the General As sembly will give emnhatic expression to the sen timents of the people. U cannot fall to arrest attention that all these encroachments of the Federal Government upon State Sovereignty and upon the freedom of the Territories, arises from a determined purpose on the part of those who control its actions to ex tend the domain, and enlarge the power of slavery. Under this influence the ancient and original policy of slavery prohibition was over thrown and reversed by the Kauaas-N’eWaska act. Under this influence, the whole power of the National Government tys been exerted to force slavery upon the reluctant people of Kansas. Under this influence, also, p«r»i#n*ui attempts are mnde lo subjugate «!'*• people °f : the Free Stales to federal domination through \ the administration of the Fugitive Slave act. Under this influence, finally, the Federal Judi ciary has promulgated the revolting doctrine that the Constitution of the Union establishes and guaranteed slavery in all national territory; -.and consequently that (here is no foot of our widely entended domain, outside of States whose constitutions prohibit slavery, where the free laborer can find a home exempt from the in trusion of that very peculiar institution. The rapid progress of despotism cannot tail to arouse and fix the attentian of & reflecting people. It/orcf9npon (he country momentous issues between two opposite systems of govern meat—two opposite theories of the constitution Theaeißsues are radical and vital. Shall the government of this country be administered by the people, for the people, or by a privileged class; for a privileged class" is the constitu tion, in feet, what it is now claimed to be, the bond and guaranty of slavery; or what the fa thers of (be Republic believed it to be, the shield and safeguard of Liberty ? Does it establish Slavery everywhere outside of Free States, or Liberty everywhere outside of Slave States " Shall the power which it confers be used for the extension and perpetuation, everywhere, of hu man bondage, or of human freedom. It te not doubtful where, upon these issues, the majority of the people of Ohio will be found. Their traditions identify them with Freedom and free institutions. The mainspring of their pros perous progress is in the prohibition of slavery by the Ordinance of ITS*. It is this prohibi tion, transferred into her Constitution, which has attracted wtthln her borders the free labor ers of bo many lands, who have so largely con tributed to that wonderful development of en ergies and resources which inspires, at once, fer vent gratitude and honest exultation. The peo ple of Ohio will never, by their action, charge the founders of their institutions with ignorance of the true principles of popular Government, por contribute by their suffrages to the exten sion or continuance of an evil ami wrong from which they have been ho happily delivered by the wiso forecast of the Fathers of the Republic.
