'in the name and behalf of the Commonweath of • Kentucky,' dhder the direction of a president and twelve directors; to be chosen by the Leg - irlatstre:; The second section enacts that the president end directors- shall be a corporaticin, - capable'of 'MAO; and being sued, and of prip - - abasing and selling every description of proper . ty. The third section declares the bank to be ' exclusively the property of the Commonirealth. The fourth section authorizes the issuing notes; , - and the fifth declares the capital to be two mil lions of dollars; to be paid by all moneys after . wards' paid into the treasury, for the vacant . lands of: Ihe State, and ao much of the capital : - stork as was owned by the State in the Bank of Kentucky; and as the treasurer received those - moneys he Was required to pay them into the - bank. The bank had authority to receive money on depoalte, to make loans on good personal - ' !mushy, or - bn mortgage ; and was prohibited increasing Its debts beyond Its capital. Lied. .• teflons were imposed on loans; and dip accent. modations of the bank were apportioned among the different counties cf the State. The bank was, by a subsequent act, authorized to issue three milliois of dollars; and the dividends of . . the-batik were to be paid to the treasurer of the State. The notes ot•ite bank were issued in the common form of bank notes, in which the _ - bank, promised to pay to the bearer on demand the - sum stated on the face of the note. The pleadings excluded the court from considering that any part- of the - capital had been paid by the State; but in the argument of the • case it -was stated, and not denied, that all the notes , which had been Issued, and payment of which had been demanded, had been - redeemed by the bank. By an act of the Legis lature of Kentucky- it was required that the' • notes of the bank should be received en all ex ecutiozusbyplaintiffs; and if they failed to endorse on such :executions that they would be so re ' ceived, further proceedings on the judgment were delayed for two years. The Bank of the Commonwealth of Kentucky instituted a suit against the plaintiffs in error, on a promissmy . , note, for which the notes of the bank bad been given, as a loan, to, the -drawers of the note.— The defendants in the suit claimed'. that the note ' . given by them was void, as the some was given for the notes of the bank, which were 'bills of credit' issued by the State of Kentucky, against the provisions of the Constitution of the United Staten, which prohibits the issuing of 'bills of credit' by the Staten of. the United States; and • that the act •of the Legislature of Kentucky which established the bank wits unconstitutional and void." . -This was a muilt' stronger case than could be .. . made now, for this bank was not a mere char.. , tered corporation of individuals, but a State in stitution, the managers of 'which were chosen by the State, and the Profits of which went into . the treasury ,-of the State. Upon this state of \ facts the Coart (Judge Story alone distenting) decided as fillows : - . - "That the 'octet incorporating the Bank of the Commiturrealth of Kentucky was a constitution al exercise power by the State of II , entucky, and the notes issued by the bank are not 'bills of credit,' within the meaning of the Constitu tion of the United States. "The terms bills of credit, in their mercan tile sense, comprehend a great variety of evi dences of debt which circulate in a commercial • - country.: In the early hittory of banks it seems - 1 their notes were generally denominated 'bills of eredite'but in modern times they have lost that designation, and are either called 'bank bill,' or 'hank notes? .;Bat the Inhibitions of the Consti ,, tation apply to bills of credit in a limited sense. "The definition of a bill of credit, which in cludes all classes of bills of credit emitted by . the Colonies or States, is a paper issud by the severely' power, containing a pledge of its faith, and designing to circulate as money. "A! State cannot emit bills of credit, or, in other words, it cannot issue that description of paper, to answer the purpose of currency, which was denominated, before the adoption of the , Constitution, 'bills of credit.' But a State may graniects of incorporation for the attainment of those objects which are essential to the in . tennis 'of society. This power is incident to eoverelgnty, and there is no limitation on its exerciae'by the States, In the Constitution, in ' respect to the incorporation of banks. "To co n stitute a bill of credit, within the Constitution, it muse be Issued by a State, on the-faith of\a State, and designed to circulate as money. It must be a paper which circulates on the credit or a State, and so received and used in the ordinary business of life. The individu , ,al or committee who Isaac's 'lt must have power to bind the Etinteuthey must set at agents, and of coarse not incur any personal responsibility, • nor impart, as individuals, any credit, to the paper - These are the leading characteristics of • a bill of credit, which a State cannot emit." • Thit would be dechive, if the Supreme Court had a decent respect for Its own opinions; brit. if the party demand a reversal of it, no doubt I the demand will be complied with. Tue Washington correspondent of the Balti more, Son Writes: 4.1. learn that great numbers of democrats, in cluding pro-slavery men, have taken the same position with that of Governor Walker, and demand for - Kan s as the rights which the K.tinsas :lebraska act was intended to secure to them. Nine-tenths of the people of Kansas are opposed, and will resist by force, if necessary, the impo sition upon them of any form of government of which they disapprove. The questionthere has ;used beyond the original contest between pro and con slavery 'men. The question upon.which , parties indiatisas are now arrayed is 'tether the people shall have the right of self-govern- Anent. Whether Governor 'Walker will be able to impress his own iewsupon the administration in regard to the subject is to be seen. J. Walker, Governor, could obtain a coil , of—a constitution which not even one in fifty of the people of Kansas would vote for if they could and which they are not to be al lowed to vote upon at all, is to be laid before Co ngress and the administration is to ask that body to admit Kansas into the Union as a state with this slave constitution thus smuggled upon the op • pressed people. In its meanness, in its utter contempt for everything that is called natural or constitutional right, in the deep debasement at the foot of slavery which it shows, and in its utter disregard of promises made before the election of 1856 to the hoodwinked people of this State, history can show no parallel to this act which it is now in contemplation to fasten upon the free people of Kansas , • The whole eventful history of Kansas for three years last past is readily summed up. It was free: the 'harrier of freedom was broken that it might be made a slave state; °slave state it is to be made. There is one thing can save it and that is for the men in Kansas who help make congresses and presidents, to breathe the command that shall set on foot' the ten thousand free armed citizens that have gone there to make themselves a hoists, and give to James Buchanan, his minions in Congress maids mer cenaries in Lecomptou such a lesson as the world will never forget—such a lemon as ty rants may lay to heart forever. Gov. IVALE.6II. TO BE REMOVED.—The corres pondent of the Courier 4. Enquirer telegraphs as follows: ..WASHAGTON, Frittay night, Nov. 27.—The split between Governor Walker and the President,! is complete. Governor Walker denounces the closing pre eedings of the Lecompton Conven tion, as a base outrage upon the people, and he repudiates any complicity with it. He left Kan- sus eight days after the Convention adjourned, but he could get no copy of theConatitution. No one knows accurately what it is. Gov. Walker also says that the legal Vote on the Constitution will be contemptibly small, because it is repeali- I aced by National Democrats and Republicans alike. lle believes the Constitution will be re jected indignantly by Congress, that the Shivery question was settled by the October vote, and that Kansas will be a Free State. He says he will stand or fall by the right of the People to form their own Constitution, and he believes that the Senate will confirm him by a large majority. If not removed he will again be in Kansas on the seventeenth of December next. "The President approves the Lecompton Con vention, censures Walker, and will certainly re move him. Insmeron. The cane belonged to Banks, the editor of the South Side (Va.) Dem ocrat. Now, this fellow Banks, who thus sports a Brooks cane, was well whipped a few months since by the Virginia correspondent of the New York Herold. Why don't he show the cane with which thult _aperatiog was performed? Doheny, who 'held the cane .up for the admira tion of the crowd, was the principal speaker at the Sepoy sympathy meeting in New York,alMut the time that the news of the butchery of babies by the Sepoys was captivating the fancy of each patriots as himself. TUE LATEST FILLMUSTERING EXPEDITION.- Some mystery shrouds the connection of the steamboat Fashion with Walker's last fillibuste ring enterprise. She was formerly a govern ment vessel, laiddniving been recently sold in New Orleans for a nominal sum, was bought, as was alleged at the time, by the riends of Gener al Walker: This being now proved accurate, the whole proceedingwears a very suspicious aspect. All the responsible government officials at Mo bile and New Orleans have evidently connived at the fitting out and sailing'of the new expedition. Did they also furnish the vessel? The freight list of the Fashion as given at the Mobile cus tom house, included only such articles as would be needed by a. military enterprise for provi sions, outfit, etc., yet the vessel was described as being very heavily laden; insomuch that an ordinary sized man might dip water from her side with a bucket. A LECTURE on "Catholic Education" was delivered by Archbishop Hughes on Sunday night, in the Roman Catholic Church, in James. street, New York. He attributed the prevalent Immoralities to the godless character of these schools, and urged on the Catholics the propriety of patroniting only such educational institutions as those conducted by the Christian Brothers and Sisters of klerey, under the im mediate inpenision of the Catholic Church.
